D.C. parents are suing city officials over a new law that allows children 11 and older to acquire vaccines without permission from parents.
Four parents of students at several public schools — both traditional and charter — said giving children the autonomy to get immunized on their own violates parents’ rights and religious freedom, according to a July 12 lawsuit filed in the U.S. District Court in Washington.
“All parents have a right to be directly involved in medical decision-making about their children,” said James Mason, an attorney representing the parents.
It is the second lawsuit brought in recent weeks by parents who want the federal court to strike down the law, which went into effect in March.
The D.C. Council voted 10-3 in November to allow minors to give their own consent for vaccines recommended by the Centers for Disease Control and Prevention, even if a parent has filed a religious exemption.
It is unclear if or how the legal challenges will affect the city’s efforts to inoculate youth against the coronavirus before the next academic year starts.

Just in case you think this story is too absurd to be true, you can read the bill granting 11yr olds explicit right to consent, “B23-0171 – Minor Consent for Vaccinations Amendment Act of 2019“, on the District of Columbia Council Website.
What about my claim that the law authorises “clandestine” medical procedures? Councillor Vincent Gray attached the following amendment to the original law:
“The provider shall notify the insurer that the immunization has been provided under the authority of this section.”
Rationale: This amendment requires the provider to notify the insurer that the immunization has been provided under the authority of the “Minor Consent for Vaccinations Amendment Act of 2020”, so the insurer will know that they should not send an Explanation of Benefits (EOB) for the vaccination. Without this amendment, the insurer would not be on notice that they needed to refrain from sending the EOB.

I’m not a lawyer, but the above amendment appears to be an instruction to insurers to not send an Explanation of Benefits to the policy holders, in this case the parents. This appears to be an instruction not to inform the parents that a medical procedure has been performed on their child.
To say I am shocked is an understatement.
An 11 year old is not capable of giving informed consent. I remember what I was like at age 11 – I mostly did what the teacher told me to do. I was a kid, and that is what good kids do – they obey adult authority figures.
The idea that a school can administer a non-emergency medical treatment which could injure or in rare cases even kill a child, without talking to the parents about it, or providing any warning to watch for side effects or adverse reactions, in my opinion is a total breach of trust.

Our teachers opted to do their utmost to keep schools closed. There is talk of innoculating under 18s, but here I would expect that to remain a matter for parents, although given the direction of travel above – is your child in the right body? – I could well be wrong.
A law that removes criminality from the act and legalise it, within the clause of “a child’s consent”, by completely diminishing and nullifying the parents rights… and the responsibility-acountability of the authority, of the school and the state.
The problem is not the cancellation of parent’s consent…but the replacement of it with the child’s consent.
That is something…heavy and sinister… brutal.
The responsibility in this case rest with the child alone, through the consent.
All other parties, the school, the state, the community and the parents too, are “immune” to/from responsibility and also impotent to the right of challenge.

Consent or not, a medication applied or administered to a child completely outside of the clause of responsibility- accountability by all those responsible consist as an act of crime…a crime against humanity actually.

New federal law under the supremacy clause when the Republicans get back in control.
Any local or state law allowing those under the age of 18 to have a specific right of CHOICE for voting rights or medical procedures, such CHOICE shall also apply to all 2nd amendment rights of gun purchase and/or ownership.
The only reason I did not write under 21 years is the assumption that now that ONE federal judge has ruled that 18 to 20 year old citizens have a right to buy a handgun where 21 or older do, that the courts will correct that injustice. Old enough, by the constitution, to vote, you are an adult for ALL INTENTS AND PURPOSES.
Also time to remove all 18 and older from the parents’ health insurance and as dependents on taxes. That should quicken the conversion of youthful Democrat voters to conservative values. That happens in general when you they to stand on your own 2 feet.
Except that it is not the child giving consent – ever. The State is determining whether they are “able to give informed consent,” and then providing the “information.” The State is determining whether they should get the shot, or should change their pronoun, or take puberty blockers.
Will the state be prepared to take over all the parental responsibilities: feed, clothe, accommodate, care for a child when ill, transport them to where they need to go, spend time playing and talking with them, monitor their friendships and excursions, discipline them when necessary and pay every penny – I think not. That is not what in loco parentis means with respect to a teacher. It is a very narrowly restricted and limited set of responsibilities.

As I have posted elsewhere, time to block grant all Great Society programs back to the states on a per Citizen basis, not per recipient, at 75% of total current expenditures, reduced to 0% over 3 years, and let the States decide how to set the standards. Newest bright idea. Reduce the District of Columbia to only areas with government facilities with NO RESIDENTS ALLOWED other than the President and VP. Now no complaint about not having representations, and Maryland gets almost all of the 95% voting DC resents, so no change to their voting habit. Understated by CDC, one study showed Bell’s Palsy occurred in some recipients that occurred after either one dose, and in some cases both. And, another that some young adults experienced cardiac inflammation. I’d think that to be a scary precursor to future early cardiovascular disease (heart attacks).

There is another issue here. Depending on the kind of proteins used in the vaccination, there can be a severe adverse reaction. I know of a family afflicted by this, and they have opted to wait for a different vaccine to come to the market that is based on a different composition. How well can one rely on an eleven-year old convey any counter indications to the people providing vaccinations? And that is assuming the child knows. This can cause serious harm that is avoidable by involving the parents.
For children, the rate of death from CV-19 is so low that the rate of death from vaccine complications is about the same or even higher. Now consider the serious adverse effects like you mention and myocarditis, etc, and unknown long term impacts, and this is insane.
The CDC is recommending that doctors do not perform a variety of routine tests because of the number of false positives leading to more (and costly) testing and anxiety on the part of patient. I think you are saying this vaccine falls in the same logical category.
That recommendation by CDC is rational.
What I am saying is that it does not make sense from a health care perspective to subject children to risks from a treatment for a disease which presents effectively no risk to them, especially when long term effects of the treatment are not and cannot be known.

50 percent of a very small number is a very very small number. Children of this age are far more likely to be harmed by the vaccine, and that is before the potential long term affects.
When I was in grade school, that was the year the Salk vaccine for polio was distributed at school. My sister caught the virus that summer before school started, but it went to her tonsils, which had to be removed because she couldn’t breathe properly. We ALL got the polio vaxx at school, BUT OUR PARENTS KNEW ABOUT IT.
But THIS????????? Oh, no, you don’t do that without i know about it first. And what if those kids had already had the CV vaxx through the family doctor?
This isn’t just bad. It’s one more step to destruction of freedom. The parents should do more than just sue the school district.
I also received the Polio Salk vaccine in Grade School.
I remember having to bring Parental approval signed documents, which in my case was carried by my Mother for both vaccine doses.
I liked the second dose, a sugar cube, much better than the first. Plus the lines went much faster with kids popping sugar cubes.
There were a lot of parents at the vaccine sites. Few of the grade school kids didn’t have an adult with them.
For our parents, Polio was a very well known and much feared disease with most adults knowing someone who had the disease.
In contrast, my High School had students infected with tuberculosis identified causing several kids to receive treatment while under quarantine.
For such a health threat, the school sent home papers to be signed allowing students to be tested for TB.
The test consisted of a bubble of fluid injected just under the skin.
Positive reactions caused inflammation and results were near immediate, but we all got to sit and have our injected sites checked by nurses before we could go back to class.
A surprising amount of kids fainted. Most fainted when they watched someone ahead of them get the shot, a very few fainted when they got the shot.
The paperwork sent home specified that return to classes would only be allowed when the school had copies of their negative TB test on file. A requirement that minimized how many didn’t have their parent signed paperwork.
Those who missed the school’s TB test had to get tested elsewhere.
We also got tested for TB in grade school, every fall in the first week. The second polio vaxx I got was the sugar cube, too, but in 7th grade. Then again, in Navy boot camp, got a smallpox vaxx, another polio (sugar cube) and a bunch of other vaxxes. And no one questioned that there was a benefit to any of this.
But now?? Well, I got my CV19 vaxx in mid-June and will get the booster in the fall, AFTER I get my flu shot. I don’t know what the problem is. The morbidity (illness) rate is slowly reducing and the mortality rate has dropped substantially. If this were another and fiercer version of the 1918 Spanish flu, would people be quite so quick to question the preventive method? I just wonder sometimes what goes through people’s minds.

What goes through people’s minds is that the “vaccines” are still experimental; that they use a novel mechanism; that no one has explained how these particular vaccines do not induce ADE like their predecessors; that they induce the body to produce a toxic protein that can maim and even kill; and that they neither prevent the acquisition nor transmission of a disease with a CFR < 1%.
In other words – if you’re healthy and under 40, the vaccines almost certainly present a greater risk to you than the disease itself does.

Most of the more alarmist experts on the subject believe that the “vaccines” may i) induce ADE, which could make any future coronavirus infections more serious, ii) that the micro-clotting occuring in lung capillaries (as the spike proteins embed themselves in ACE receptors in vascular endolthelium and disturb blood flow) will induce greater strain on the heart and bring about premature right-sided heart failure; and that there are cancer risks in tissues that wind up accumulating spike proteins and unmetabolised vaccine that escapes from the injection site in the deltoid, as detailed by Pfizer’s own bio-distribution research.
The first will probably start showing up in fall as flu/cold season picks up; the second in 1 – 3 years; and the 3rd is anyone’s guess.
Please note these concerns are based on a first-principles understanding of how the human body works, not empirical data. But that’s the whole point – we’ll only have the empirical data when the trials finish, which is not until 2022 for Moderna and 2023 for Pfizer.
And that’s assuming you can trust the trial results.
According to VAERS and EUDRA, the vaccines have killed tens of thousands of people already in the EU & USA alone, and there’s good reason to believe that adverse reactions are actually under-reported by a factor of 10.
It may be that the vaccines will do more good than harm for people who are more at risk from Covid (the old, the fat, the diabetic, etc) but as it stands, if you’re under 45 and healthy, the vaccines look more risky than the disease.

Lockdowns? Not necessarily. We don’t shut down for the seasonal flu, do we? Those are good points, but the “season” for it seems to be cold weather more than warm weather – at least here in the USA – and I’m waiting to see what happens when fall returns. Not too far off.
Look, there are ‘dangers’ in everything, including even the polio vaccine and eating margarine instead of butter. I’ve had no reaction to the covid vaxx, but my cold, which plagued me off & on all winter finally threw up its hands and went away when I got my covid vaxx in June. And since the common cold is caused by a wide variety of bugs, I had to ask my doctor if that was a coincidence or something else. Even she doesn’t have an answer to that.
I understand the desire to act with caution, especially in regard to something this new and strange, but would you have felt the same way if this were 1918 and the Spanish flu (which was brought to Spain earlier by Chinese workers looking for work) was going around and killing off thousands, like wildfire, and suddenly, someone found a way to stop it?
Considering the plagues of various sorts that swept through Europe in the Middle Ages, when the only “medicine” available was to bleed the sick or hope it didn’t hit you, and otherwise isolate yourself from them, would you rather nothing was done to try to stop this virus from doing more harm?
At least this fall, when cold weather comes back (and viruses love cold weather), we should be better prepared to deal with it.

Sara, it’s unreasonable to compare the risks of Covid with the Spanish Flu, which is probably around 40 x as deadly, and – unlike Covid – k!lled far, far more young people.
Arguably, even the average seasonal flu is more deadly than Covid in terms of QALY.
And if you don’t know what QALY is, perhaps you need to do some research before expressing patronising disbelief at other people’s decisions concerning (experimental) medical interventions.

My brother had a 1.5 year old stent…and died of a massive heart attack 10 days after his first “vaccine” shot. As the doctors tried to save him, they had to immediately replace the stent as it was clogged with clotted blood, in spite of my brother being on blood thinners and the new stent. I hope the experts are wrong. Knowing what I know, the experiences I’ve had in my life…I trust no government. Have a healthy Fall. Try to be safe.

If their chance of bad COVID-19 reaction is less than 0.01%, why bother lower it to 0.005% for a treatment with unknown long-term side-effects?
And, by the way, it is NOT a vaccine! It is gene-therapy. The smallpox vaccine prevents you from getting smallpox. The polio vaccine prevents you from getting polio. The flu vaccine prevents you from getting the flu strains that are in the vaccine. (The only reason why the flu vaccine isn’t better is because it is very difficult to know which flu strains will spread months ahead of time.) This treatment does nothing to keep you from getting or spreading the virus. Indeed, it seems with it you can be an asymptomatic super-spreader. Without it, you cannot be an asymptomatic spreader.
The safest and cheapest thing we could have done is isolate the vulnerable, prescribed cheap and off-patent drugs that have been proven to work against past coronaviruses, and let those most likely to recover build up herd immunity. But, this was never about your health.

The DC council voted to allow vaccinations of school children without parental consent. That is not “clandestine”. If parental consent is not necessary, then parental notification is not necessary. Every school parent in DC can read the same law, so it is not a secret by any means.

This last week I spent driving between Marion, IL and Exit 16, I-65 in Indiana to the Loves truck stop there picking up Toyota service parts from the manufacturers.
Start in Marion, two stops there then to Princeton, IN and the final pickup in Lawrenceville, IL and then to the Loves Truck Stop where I traded trailers with another driver and head back to Marion to take my break and do it again the next day.
Work day was 11 1/2 to 13 hours depending on how things went.
I avoid driving the interstates when feasible. So I was doing a lot of driving through farm country, woods, and even state parks and National Forests. And some here might be surprised to learn there are a fair number of oil wells in Southern Illinois. Winding and hilly roads in some places.
As long as one uses common sense and good routing the two keys to making good time in a big rig are maintain momentum and keep the doors closed and the wheels rolling. The later is just a matter of will. The former is where the skill comes in and especially so on winding hilly roads when loaded.
I don’t race anyone but myself but gain a great deal of satisfaction driving in those conditions. Maybe it just isn’t possible to explain it and one just has to be there to understand just like nailing a tough back without having to do a single pull up.

The government has always set forth requirements for public activities, whether it is governing the voting process, or getting a drivers license and driving on public roads, or attending a public school, or boarding a commercial airliner, or building a house or anything else that ever gets built. I know that a lot of people try to refuse acknowledgment of such, but a civil society cannot be built or maintained if there were no laws and rules for participation.
The government cannot force you to get a vaccination per se.. but the government can force you to get a vaccination as a condition for attending a public school. If you cannot or will not comply with that, then you can send your kids to a right wingnut anti-vaxxer school, or get them home schooled. It’s a free country.

I personally know two people who had adverse reactions to the injections. When I asked if they reported the reactions the answer was no. One of the reactions was basically 24 hours of agony. I wonder how many other people with these types of reactions did not report.
An MD told me the other day that she has seen over 70 adverse reactions, but has only reported one of them to VAERS because each report takes about 30 minutes to fill out, and she said she just doesn’t have the time.
Within my circle of friends & acquaintances (and friends of acquaintances & acquaintances of friends), I know of 3 people that actually died from the shot (2 elderly with blood clotting issues & 1 in his healthy forties w/ an autopsy that said multiple organ failure).
With the same 2 degrees of contact, I know of 2 covid deaths.
No one I know had any kind of reaction other than some soreness or a slight headache. In addition, the scores of people who have come into my store and with whom I have screened on the phone prior to in home services, have not had any reaction other than again some soreness or a slight headache. Most have had no reaction at all. This vast and varied sample far outweighs the simple “a couple of people I know” anecdotes.

Not too sharp are you? It is not rocket science. Any death after the vaccine has to be reported. This vaccine has been administered to the elderly first. Elderly die more often than the rest of us. Similar was something the former NDP/communist government tried to slip thru here in Alberta, a law stating that if a kid wants to join what they call GLAD’s (gay/lesbian alliance) groups in their school, the teachers were specifically ordered to not inform parents.
While i don’t care what orientation my kinds end up as, i will support them, i absolutely opposed this law as infringing on my right to know.
As of today, approximately zero kids have been offed by their parents for admitting to joining such groups, which was the stated purpose of the law as proposed.

If the court rules that the measure was unlawful, and done without authority, was every vaccine given not an assault ? A civil assault tort at the least ? Where does the “Health Department/Ministry” level of authority for medical treatment rest in the strangely constituted “District” ? The Council’s instructions to withhold notice to parents should have set alarms off with the insurers? And could signal to a Court that that instruction clearly shows the Council knew they were doing something wrong. The presence of a strong independent media is supposed to catch this kind of legislation in open session even at the municipal level. What did the three councillors who voted against the change do after the vote ?

As a physician, if I did this I would expect to be disciplined by my college, possibly sued by parents, and would personally lose confidence in my own judgment and my commitment to the wellbeing and autonomy of my patients. CoVID vaccines may well be very effective at preventing infection, illness and death from the virus, though our understanding is still early days. They are not approved in the sense of having met every regulatory requirement for proof of efficacy and safety. They are being used under emergency approval only and should be considered experimental.
Everyone who receives the vaccine (I have had two shots myself) needs to be fully informed of the risks and benefits, made aware that they are not yet fully approved, and provide fully informed consent before receiving the shot. 11 year olds are not in a position to provide informed consent for a research procedure and their parents or guardians must be involved in the decision.
Yes, vaccines are part of a risk management protocol, and people should critically review the available facts, weight the benefits, and, whether it is a vaccine, a therapeutic treatment, or behavioral change, decide how to minimize their individual risk.
When you hear 99% of those who are hospitalized or die are not vaccinated, know this is one of the tricks they’re playing: not fully vaccinated (i.e., received 1st, but not 2nd ClotShot) = not vaccinated.

11 year olds are not getting vaccinated, because the schools are certainly following the rules to only give vaccines to children of ages that the vaccines are approved for, which is 12 years old and older. Also, I think that a 12 year old can give consent to a beneficial medical treatment that is being withheld by parents on basis of religion; there is past precedence in the courts for children to get medical treatments that parents deny their children on religious grounds.

There are diverse reasons to avoid these vaccines in the general population, and people pushing them need to be recognized and held accountable.

What of the risk of anaphylaxis in administering a vaccine without medical history? What happens if the child refuses consent? I thought the vaccine was only authorized for use by ages 12+. This is absolutely abhorrent.
Here in Australia, the Therapeutic Goods Administration (TGA) has just approved the Pfizer vaccine for children between 12 – 15 years of age. I am hoping parents refuse to allow their children to be “vaxed” without their permission, ie, when at school.
50 years from now the headline will read “OUTRAGE! Government secretly gave experimental vaccine to minority students in DC without parental consent” and then blame the white man.
