Re: CO2 Coalition Challenges Governor Newsom on the 2009 EPA Endangerment Finding

Dear Governor Newsom and CARB Leadership:

Good news: There is NO climate crisis in California.

This letter is a response to Governor Newsom’s September 22, 2025, letter to U. S. Environmental Protection Agency (EPA) Administrator Lee Zeldin (https://www.gov.ca.gov/wp-content/uploads/2025/09/GGN-Engangerment-Finding-Letter.pdf) and CARB’s September 22, 2025, summary of submissions to EPA and the Department of Energy (https://ww2.arb.ca.gov/news/carb-submits-scathing-critique-u-s-epas-illegal-effort-overturn-endangerment-finding) that defend the 2009 EPA Endangerment Finding.

You claim that “greenhouse gases endanger public health and welfare,” that “climate-warming gases are killing people,” and that there is a “climate crisis” in California and the United States.

We challenge the validity of these claims with strong evidence that greenhouse gas emissions are not harming Americans, and that there is NO climate crisis in California and the United States. This evidence has been compiled by the CO2 Coalition, a nonprofit organization with the goal of determining and propagating accurate facts regarding carbon dioxide (CO2) and the climate. The key findings provided below stand in contrast to your claims that greenhouse gases are deadly air pollutants, and that wildfires, “extreme heat,” drought, and floods are becoming more frequent and severe.

More details, including the scientific data, can be found in these  CO2 Coalition documents:

The letter sent to the CARB on March 22, 2024 (https://co2coalition.org/publications/an-open-letter-to-the-california-air-resources-board/).

The written comments submitted to the EPA on September 19, 2025 (https://co2coalition.org/publications/co2-coalition-comment-on-epa-endangerment-finding/) and September 22, 2025 (https://co2coalition.org/publications/co2-coalition-comment-2-on-epa-endangerment-finding/).

In summary:

Modest warming of California is beneficial and not a cause for concern: Globally, significantly more people have died from the cold than from the heat since 2000.

Increase in agricultural production: The combination of lengthened growing seasons (from warming) and increased CO2 concentrations has contributed to this increase.

CO2 is essential: Plants need CO2, sunlight, water, and nutrients from the soil to produce food and oxygen, both of which are essential for human and animal lives.

CO2 is beneficial: Exposing plants to higher concentrations of CO2 increases their growth, food production, and drought-resistance; and greens the Earth.

CO2 does not cause dangerous warming: Over the last 10,000 years, global temperatures exceeded our current temperature more than 90 percent of the time, despite the CO2 concentration being much lower at ~ 280 parts per million (ppm)

CO2 is harmless: CO2 only becomes harmful to humans at concentrations on or above 8,000 ppm, which is much higher than today’s atmospheric CO2 concentration of ~ 425 ppm.

California is in no danger of unusual drought: The annual precipitation in California has fluctuated greatly over the last 150 years, with only a slight decrease.

Ski resorts are experiencing more snow: Most (21 of 22) ski resorts in California had increasing snowfall from 2012 to 2023.

California is in no danger of drowning: North Spit, CA, has the highest rate of sea-level rise of 0.005 meter per year, or 1.64 feet in 100 years, which is easily mitigated; while other locations, including Los Angeles, San Francisco, and San Diego, have rates of sea-level rise of less than 0.003 meter per year, or less than one foot in 100 years, which is also easily mitigated.

Fewer natural disasters over the years: Significantly reduced number of wildfires and acres burned were reported in the United States and globally.

Air quality in California keeps getting better: The major air pollutants are at their lowest levels ever and they are not killing any Californians.

In conclusion: There is NO climate crisis in California, and CO2 is essential and beneficial for life on Earth. Therefore, the CO2 Coalition recommends that policies should be enacted based on scientific evidence, rather than politics.

If you need additional details, the CO2 Coalition will be happy to respond to any inquiries you may have, and the members of the CO2 Coalition will be happy to meet with you for further discussions.

Sincerely,

Gregory Wrightstone
Executive Director

What legal obligations do CARB and the governor have with letters like this? Can they just toss them in the trash, do they have to log them, are they obligated to send back even a form letter acknowledging receipt?

I tried sending letters to my Congress Critters for a year or two, many years ago. At best I got back form letters, usually for something unrelated.

That is par for the course all around the Western world. Politicians mistakenly believe that they are omni-potent rulers over the People. The unrelated form letter response is the ultimate FU to a citizen, and politicians are long overdue to be made to pay for their intransigence.

Yes, so I discovered. I may have even tried writing back once complaining about the wrong response, but that might also just be wishful thinking.

I volunteered for the Navy after being an unofficial draft dodger, had a great time, but the recruiter lied to me; said I could take my electric shaver to boot camp. I wrote him a letter from boot camp, complaining that yes I had been able to take it to boot camp, I just couldn’t use it, and that was a lie in my book. He wrote back to the company commander (the navy’s version of drill instructor) and I got in trouble. I don’t know how I survived four years of salutin’ and sirrin’, but I don’t regret it for a minute.

Politicians mistakenly believe

They’re not mistaken as long as the voters allow them to be.

Harold The Organic Chemist Says:
RE: CO2 Has Caused No warming Of Air Since 1920

Shown in the chart (See below) are plots of temperatures at the Furnace Creek weather station from from 1922 to 2001. In 1922, the concentration of CO2 in dry air was 303 ppmv (0.59 g CO2/cu. m.), and by 2001, it had increased to 371 ppmv (0.73 g CO2/cu. m.), but there was no corresponding increase in air temperature at this remote desert.

The reason there was no increase in air temperature at this arid desert is that not only is there too little CO2 in the air, but also the CO2 absorption band at 667 wavenumbers (15 microns) has become saturated at 303 ppmv. For CO2, the saturation concentration level begins 300 ppm. In 1920 the concentration of CO2 in dry air was 300ppmv.What this means increasing the concentration of above 300 ppmv will not result in an increase in air temperature.

A research paper on the CO2 saturation effect is:
“The Saturation of the Infrared Absorption by Carbon Dioxide in the Atmosphere” by Dieter Schildnecht.

To check if there has been any warming in Death Valley after 2001, I went to:
https://extremeweatherwatch.com/cities/death-valley/average-temperature-by-year. In 2024, the average annual temperature was 26.7°C, a slight increase over the average annual temperature in 2001 of ca. 25°C. However, I don’t much trust NOAA’s temperature data since it has been “adjusted” and “homogenized” (and probably
pasteurized!).

At MLO Hawaii, the concentration of CO2 in dry air is 425 ppmv. One cubic meter of this air has a mass of 1.29 kg and contains a mere 0.83 g of CO2. There is too little CO2 in the air to be harmful to the human health and welfare. Note how little CO2 there is in the air.

CO2 is quite beneficial to humans because it can be used to extinguish fires, to enhance the growth and productively of food plants in greenhouses, to put the sparkle in soda pop, beer and champaign, and to leaven backed goods.

NB: The chart was taken from the late John L. Daly’s website:
“Still Waiting For Greenhouse” available at: http://www.john-daly.com. From the home page, page down to the end and click on: Station Temperature Data”. On the “World Map”, click on “NA” and then page down to:
U.S.A.-Pacific. Finally, scroll down to “Death Valley”.

The lamentably late John Daly.

He was a hard-minded, analytically gifted, relentlessly effective skeptic of the whole AGW grift.

I recall UEA’s Phil Jones celebrating John Daly’s death.

If everyone learned of John Daly’s website, all this nonsense rhetoric about greenhouse gas emissions, global warming, and climate change would vanish overnight. Unfortunately, he died too early to save Australia from the draconian climate agenda of the Canberra Climate Commissars. There is a file about him at Wikipedia.

The US EPA will soon rescind the 2009 CO2 Endangerment Finding, and hopefully the greatest scientific fraud since the Piltdown Man will come to an end and all radical environmental NGO’s will go bust.

Be sure to go and check out the Extreme Weather Watch website. In the link put the name of you city after …cities/
If you city is in NOAA’s temperature data base, the Tmax and Tmin data will be displayed in table. You will probably find the city has warmed up which is due to the UHI effect.

Below is the chart for Brisbane. Note how flat the plots of temperature are.

California politicians are not going to listen to the CO2 Coalition.
California is a one party state and only listens to its own propaganda.
That’s why Newsom started doing his own podcasts. To spread this propaganda.

climate-warming gases are killing people,

Couple of minor problems. Climate is the statistics of weather observations, and a number. Anybody who believes that a number can be warmed is plainly stupid.

If there is an implication that adding CO2 to air warms it, anybody who believes the implication is as stupid as the person who made it.

Talk of “killing people” with “climate-warming gases” is just emotive nonsense.

It is completely pointless in responding to idiots – it just make themselves think that their bizarre fantasies are of value.

“Killing gases” is a direct result of persistent Marxist drip-drip-drip corruption of our language that was also used to influence sad-sack Justice Robert’s to ignore the clear terms of the Clean Air Act – hence, the Endangerment Finding.

Congress explicitly excluded CO2 as an air pollutant in the CAA. But Lefty academics, NGOs, eager regulators and “green trough” feeders claimed (without evidence) that CO2 warms the atmosphere, warming causes innumerable calamities (“harms”) to humans and, thus, must be a “pollutant”.

That’s how CO2 morphed from the scientifically documented “gas of life” into “air pollution”

This is evil/malicious, not stupidity

If co2 can be a pollutant than words can be violence.

But isn’t it a bit strange that a country that is at perpetual war with someone else and has killed millions(based on lies as obvious as AGW)
is so sensitive?
“We can destroy countries but don’t say a wrong word”
is as crazy as things can be.

Of course this words-violence,hate speech and warming crap has nothing to do with sensitivity or protection but to create standards that can not be implemented by law (“We will force behavior “- Larry Fink, Blackrock)
or that could never become law without a necessity.

It is a sad truth, but there is no scientific evidence available that will ever persuade someone with religious belief to change their views or position.
The facts are indisputable but the zealots in the Climate Alarm community and those with vested interests determined to maintain the myth that climate change is dangerous simply will not be moved by rational logical scientific fact.
With that in mind we have to adopt an alternative strategy to bring sanity back into public discourse regarding climate variation.
The most effective instrument to return to sanity is economic. Those areas such as California fixated on so called man made climate change dangers driven on by Newsom and others are haemorrhaging wealth. Other states such as Texas are gaining at the expense of Newsom. At some point even the left wing advocates driving this nonsense will have to concede they are wrong.

There will come a time when reality can no longer be denied, even by Newsom and California.

That time will come, not when the scientific evidence is overwhelming, but only when the consequences of denying reality become sufficiently painful that they cannot be ignored. Still they will never openly concede the point, they will simply change their tune and act as if it were always that way.

They won’t admit they were wrong, they will just pivot to some new scare and quietly stop beating the drum for the old scare. I’m half-convinced this is some of the reason for wokism, Queers for Palestine, and the rest of the recent nonsense. 15 years ago, chemical castration and female genital mutilation were the crimes of the century. Now several states have made it child abuse for parents to not provide these or to ignore preferred pronouns. I can’t think of any reality which could cause such a major change so fast, but needing a new panic button fits the bill.

Texas produces more Green Electricity than any other state in the USA, including California.

Five years ago, that made sense politically.

Texas pumps (or used to pump) the largest amount of oil and natural gas in the USA.

From the article:

“In summary:
Modest warming of California is beneficial and not a cause for concern”

And the warming may be only temporary, going by weather history.

Assuming warming will continue into the foreseeable future is just speculation not backed by any facts, nor by the history of how the climate behaves, which shows a cyclical movement which warms for a few decades and then cools for a few decades and then repeats the process.

We are in a “warms for a few decades” period at the present time. What comes next is “cools for a few decades” according to weather history.

The temperatures have been cooling since about February 2024.

It’s abundantly clear that global efforts to control CO2 emissions have failed miserably. Rather than following a path to “net-zero” emissions, the world had increased its CO2 emissions by half a million tons annually. Global CO2 emissions by year 1940-2024| Statista

However, this benefit of CO2 emissions, “Exposing plants to higher concentrations of CO2 increases their growth, food production, and drought-resistance; and greens the Earth.” is a real problem for California and its wildfires. More CO2 means plant growth more efficiently uses water so it should be particularly beneficial to plants in dry climates. Additionally, the state mandates that wants to send more mountain run-off to the oceans means worse desiccation in the foothills. Consequently, California needs to put greater effort into controlling the ignition sources and mountain fuel loads to reduce risk.

The fact that Gov. Newsom seems to commit more of his personal energy into efforts to control the weather when there is infrastructure development and forest management that is under the state’s jurisdiction is evidence of how dysfunctional the state has become.

A suggested message for public consumption

“Our planet has now reached saturation point with CO2.
It’s done all it can to and for the atmosphere, which does what every natural body does when it’s got all it wants & needs of a consumable – it safely stores it for future use if it has the spare storage spaces, or tips the excess out into the garden (which in the case of CO2, is space).

The CO2 that is being held for use in our storage lockers – earth, oceans, atmosphere, forests, etc gets consumed and replenished as required from these and other sources.

So CO2’s role in our world is a very cool self-regulating operation that’s been developed by natural processes over some 4 billion years, and going on quite smoothly today.

Bottom line –
Earth knows what CO2 is, how it works, what recipes it gets used in, how long it keeps, how much to use, where it can get more if needed, what it will and won’t complement as an ingredient, and so forth and so on.

So for all those people who’ve been trying these past 50 years to figure out what message Earth sends about CO2, it is –
“Get the fuck out of my kitchen! NOW!!”

This is a First Amendment issue, as CARB is treating the effects of Man on the environment as a religious dogma. So, in accord with the faith they have established, all emissions are “pollution”, no matter the level or provable effects.
It is religious, as their devotion to such dogmas as L-NT effect models on radiation and chemical health effects are immune from any evidence. So is their devotion to greenhouse gasses being both evil and the cause of equally evil climate change.

Sort of…

The first clause of the first amendment states that the church will not be part of the state, i.e. no state mandated religion (keep the church out of the state), and the second clause basically says that the state is to keep out of the church, which is something that Newsom overlooked with his orders during the Covid mess.

The only climate crisis that really exists is in the minds of governments hoping to use term to justify new taxes that will supposedly combat a non-problem . So the crisis is that their fabrications are being rejected by their constituents. Likewise the peddlers of overpriced and inefficient green products. It’s a crisis to their bottom lines that they’re not selling them and that the subsidies are drying up.

October 4, 2025 8:45 am

Therefore, the CO2 Coalition recommends that policies should be enacted based on scientific evidence, rather than politics.

Here’s the problem…you are advocating that the wishes of the majority of voters in the state of California NOT be followed by the government. That is a danger for democracy. You need to educate that majority, or at least reiterate that in a republic they elect people who make an effort to study the problem before enacting legislation….. so that the public might be more selective over who they vote for.
