California Governor Newsom’s Actions to Reduce Emissions Conflict with The States’ Legal Framework Statutes

Laws focus on reducing emissions, but actions are prolifically against written statutes increase emission worldwide by “leaking” them to other countries.

California Governor Gavin Newsom has been vocal about his commitment to reducing greenhouse gas emissions in the state. However, some of his recent actions of “leaking” emissions to other countries violate many sections of the written legal framework of The California Environmental Quality Act (CEQA) and California Global Warming Solutions Act (AB32).

His actions have raised concerns among legal experts and environmentalists, as they conflict with the state’s existing legal framework statutes which prioritize the affordability and reliability of electricity sources over their environmental impact.

The written legal “green” framework statutes in California that Newsom circumvents are:

  • A California statute passed in 1970, the California Environmental Quality Act (CEQA), that was signed into law by then-Governor Ronald Reagan and was the beginning of the State’s “green” movement.
  • Then in 2006, the passage of AB 32, the California Global Warming Solutions Act marked a watershed moment in California’s history. By requiring in law, a sharp reduction of greenhouse gas (GHG) emissions, California set the stage for its transition to a sustainable, low-carbon future. 

Of those two voluminous documents, CEQA and AB32, Governor Newsom has chosen just five words from AB32 Section 38562 (4) “reduce toxic air contaminant emissions” as the foundation of his mandates, and his personal emission policy to clean the “air bubble” around California by leaking those emissions to others outside the boundaries of California.

Surprisingly, most of the California population commends him and remains very “supportive” of his efforts of increasing emissions at sites outside the borders of California, along with the higher taxes, inflation, and product shortages being inflicted upon the forty million residents of the state.

Here are a few sections from AB 32, the California Global Warming Solutions Act that demonstrate the Governor’s actions that increase the “leakage” of emissions to developing countries clean the “air bubble” around California:

  1. AB32 section 38564 states: “The state board shall consult with other states, and the federal government, and other nations to identify the most effective strategies and methods to reduce greenhouse gases, manage greenhouse gas control programs, and to facilitate the development of integrated and cost-effective regional, national, and international greenhouse gas reduction programs”.
    • Newsom, by continually decreasing in-state oil production, Newsom’s emissions policies continue to force California, the 4th largest economy in the world, to be the only state in contiguous America that imports most of its crude oil feedstock to refineries from foreign countries. That dependence, via maritime transportation from foreign nations for the state’s crude oil energy demands, has increased imported crude oil from 5 percent in 1992 to almost 60 percent today of total consumption.
    • California’s growing dependency on other nations, like Saudi Aramco, some not particularly friendly to America, is a serious national security risk for all of us. It also deprives Californians of jobs and business opportunities and forces drivers to pay premium prices for the fuels and products manufactured at the decreasing number of in-state refineries.
  2. AB32 section 38562 (8) states: “minimize leakage”.
  3. AB32 section 38562 (2) states: “Ensure that activities undertaken to comply with the regulations do not disproportionately impact low-income communities.”

In addition, President Joe Biden and California’s Governor Newsom continue to support subsidies to procure EV’s and build more wind turbines and solar panels, when those subsidies are providing financial incentives to the developing countries mining for those “green” materials, which promotes further exploitations of poor people in developing countries.

I personally thought that President Biden and California Governor Newsom had higher moral and ethical standards that would stop them from financially encouraging developing countries from continuing their exploitation of the poor with yellow, brown, and black skin, and further environmental degradation to the landscapes in those distant developing countries.

Gavin Newsom was anointed the title “Young Global Leader” in 2008 by Klaus Schwab in Davos. He is committed to the WEF’s “The Great Reset” which advocates for unlimited immigration (with Soros and Obama) (Cloward-Piven Strategy), and a Planned Economic Collapse to initiate the “Chinese Economic Model” of Neo-Feudalism. His Butt-Buddy Justin Trudeau is ahead of him in accomplishing the transition to an authoritarian State. Newsome has the First and Second Amendments slowing him. California exports its pollution? I’m shocked!

If you look at oil, natural gas and electric power imports, 75% of California’s energy comes from outside the state. But the renewable energy California hopes to expand like solar power in its desserts and the electrification of everything requires enormous mineral resources and almost none of those will come from the state, even if those resources are available in the state.

Ironically, one project in the state to cut CO2 emissions is the California high speed rail line which has already spent $10 billion on the section connecting Fresno to Merced and costs will exceed $100 billion if the entire system is completed. Meanwhile rural hospitals along the path of the rail line are losing money and the only hospital in Madera county ( just north of Fresno) shutdown in this year because MediCal only pays 60% of the cost to treat poor patients and there are not enough people with private insurance to make up for the losses. With a $30 billion operating deficit this year and Sacramento’s priority on the saving the world from CO2, don’t expect much relief for the poor’s healthcare services anytime soon.

This is exactly why States pushing “decarbonization” need to be severed from the national grid, so that the utter failure of their bone-headed policies cannot be hidden by the sleight of hand of importing energy to meet demand that is not, cannot, and will never be met if their policies spread to the entire country.

Why would you think that? Biden and Newsom have no moral or ethical standards. Whatever works to keep them in power (legal or illegal, in Biden’s case) is the standard they have set for themselves.

Of course they have moral and ethical standards. In fact, they have twice as many standards as most of us. They have one standard for themselves and another standard for you or me. And they have those 2 standards on nearly every subject.

Rid your self of the mind set that there is any thing approaching the concept of logic ,ethics ,morality or the rule of law or even the “ spirit of the the law”. It is all gone now. Just a matter of how the civil society is going to unravel and how quick. Or you just accept a corrupt dictatorship

“In 2021, imported foreign crude oil approached 300,000 barrels per year. It took 150 Very Large Crude Carriers (VLCCs) oil tankers, each with 2 million barrels of crude oil, which were required to meet the demands of California.” 

The actual number is 300,000 bbl/day, not year. Minor correction, but important. The US consumes 20 million bbl/day of crude which is about 16 million of fuel and 4 million for chemicals and plastics. Without the baseload production of fuel, a refinery would not be economical and we would lose the chemical production. Without plastics, life as we know it would not exist as everything would be more costly and less available. Without the baseload of fuel production, our refinery infrastructure would die quickly and we would all suffer for it. No clothing, not food packaging, no medical equipment, no other necessities of life that we simply take for granted in a “modern” society which is now being destroyed in the name of saving the planet.

Per California Energy Commission, it is 306 million bbl/yr. I just assumed that the value was bbl/day as that is the common unit. Foreign Sources of Crude Oil Imports to California

PADD 5 (West Coast) imports are 439 million bbl/yr. Crude Imports (eia.gov)

California has decreed that the high aromatics heavy crude from the San Jaquin valley is not acceptable for use in CA and they must import crude to reduce GHG emissions. Now who would have thought that it is better to use other countries products rather than your own just to “Save The Planet”?

Be warned of harsh winters in North America. During times of solar low activity, on central North Pacific high forms, bringing air from the north far into the southern US. What happened this winter in California is evidence of such a circulation. Highs in winter in the North Pacific and Atlantic, may increase ocean surface temperatures in these areas, but this will mean harsher winters in America and Europe.
