Industry Appeals Gulf of Mexico Court Ruling, Warns of Significant Consequences for American Energy Security

WASHINGTON, September 12, 2024 — The American Petroleum Institute (API), EnerGeo Alliance, the National Ocean Industries Association (NOIA), and Chevron U.S.A. Inc. today released the following joint statement after filing an appeal of the U.S. District Court for the District of Maryland’s decision to vacate the National Marine Fisheries Services’ (NMFS) Biological Opinion in the Gulf of Mexico. Under the ruling, the Biological Opinion for the U.S. Gulf of Mexico will lapse effective December 20, threatening to halt new and existing oil and natural gas production and activity in the region.

“American oil and natural gas production in the Gulf of Mexico is a driving force of energy security here in the U.S. and around the world, supports hundreds of thousands of jobs and generates billions for state and local revenue. If this ruling is left uncontested, a critical source of current and future U.S. energy supply could be in jeopardy at a time of persistent inflation and geopolitical instability. We intend to pursue all legal means to prevent the far-reaching consequences of this ruling for Gulf Coast economies and American families that depend on access to affordable, reliable energy.”

By vacating the biological opinion without allowing enough time for NMFS to issue a revised opinion, this court decision threatens to significantly slow down or halt all permits for routine, daily operations. This leaves current and future energy production at risk and undermines worker safety and environmental protection efforts.

This ruling could result in the rapid shut-down of all oil & gas production in the Gulf of Mexico. The lack of an NMFS biological opinion would mean that BSEE (Bureau of Safety and Environmental Enforcement) would have to consult with NMFS on every permit request for every operation in the Gulf of Mexico.

The Biden judge’s clearly arbitrary, capricious and malicious ruling can be interpreted no other way than as a treasonous effort to destroy US energy security. It would rapidly remove 1.8 million barrels per day of crude oil production our energy supply. The disruptive ramifications would be global.

As if this wasn’t sufficiently treasonous…

They’d be shutting in 1.8 million barrels per day of production on the heels of having gutted the Strategic Petroleum Reserve…

The oil & gas industry will almost certainly prevail in this case, however there could very well be significant production disruptions this winter.

While the lamestream media incessantly tries to credit Biden for record US oil production, the fact is that his maladministration has routinely flouted the law in their treasonous war on the US oil & gas industry…

The facts dont match the trumpanzees claims

NMFS is the service that does the assessment which has been underway for some months. The decision was stayed till end of year

I think Bill Clinton fired Every US Attorney, right off the bat. Might be a good place to start.

Removing DEI from the US military and culling the general officer ranks and faculties of the military academies and professional schools like the war colleges, etc. would also be useful.

I really like the idea of Elon Musk leading an audit of the entire government. Half the people are doing next to nothing and the other half are busy “working on” problems instead of solving them. The Mother of all Target-Rich Environments!

A President has no authority to fire Federal judges. Only Congress has that power through impeachment. But he can of course stop appointing leftwing judges if he is elected again. Right now it looks like a very close race and nobody really can effectively predict the result.

I understand this is a bait post. It has failed. There’s this thing called separation of powers and the people you are trying to entice into supporting unconstitutional extremism won’t fall for it. Trump using rule of law is all that is required to right the ship of state.

There is a very good article on Wall Street Journal summarizing the many many Harris-Biden admin lawless actions overturned by SCOTUS … with the exception that it did not mention the overturning of the Chevron precedent in Loper v. Raimondo, which is probably the biggest defeat to date for leftwing lawlessness.

Which is why the Dems are desperate to rein in SCOTUS with their so-called “court reform”. To enact their reforms would require Constitutional amendments which would never be ratified … but their plan, should they gain control of the White House and both Houses of Congress, they will enact bills to do just that and dare SCOTUS to overturn them … which they will.

This is going to be a very very long term war between leftwing radicals and the Constitution of the United States which they have already identified as an “enemy of the people”.

The judge has applied the law. Just as the SCOTUS has done over the last couple of years. The issue is that the NFMS needs to file an opinion but has not done so.

What happens in the event of a dereliction of duty by a federal agency? Does the law stipulate that an opinion must be produced or if not the existing opinion should be maintained? If not who is to say what the rules are? Another case for SCOTUS.

What would a judge in Maryland know about the effects of offshore oil drilling on fish in the Gulf of Mexico? Isn’t the Gulf of Mexico outside his jurisdiction?

Maybe this judge would be better occupied trying to decide who should be liable for the ship collision that brought down the Francis Scott Key Bridge last March, and leave oil drilling in the Gulf to people with more expertise.

I think it adds an extra layer of insight to the discussion on peak oil.
