Following up on GAO’s previous motion for leave to file an amicus curiae brief in support of the United States in U.S. v. Minnesota (see here), which the state opposed (and the court denied, seemingly misconstruing the filing which GAO seeks to support), GAO has refiled seeking permission to put its findings into the record.
This filing points to a little game AG Keith Ellison’s office is playing, exposed by a letter his office sent along with the District of Columbia’s Attorney General Racine. That June 2021 overture asked the Biden administration DoJ to support the coordinated climate litigation campaign that, we are now told, is really a matter of coincidental purely local disputes.
This letter, obtained by GAO from DoJ under the Freedom of Information Act, and years of other documentation of the fiction being portrayed, is made public in GAO’s brief.
