Supreme Court Issues Pro-Science & Democracy Ruling on CO2: Morano: ‘One Small Step for Climate Sanity, One Giant Leap for Democracy’

EPA loses – America Wins’: Supreme Court rules against overreach by EPA

Climate Depot’s Morano: “That’s one small step for climate sanity, one giant leap for democracy. Today’s Supreme Court ruling reigning in the power of the unelected bureaucracy to essentially regulate every aspect of the American economy under the guise of ‘climate change’ — has been mercifully laid to rest. CO2 is not a pollutant, humans inhale oxygen and exhale CO2. Humans are not ‘pollution. I have been stating the obvious since 2007.” See Flashback 2007: Inhofe Spokesman Morano: ‘CO2 is not an air pollutant and should not be treated as one’

“This is inevitable – and what I mean by that is the George W. Bush administration did not push back or try to change anything,” argues Marc Morano of Climate Depot. “They rubber-stamped United Nations reports and they never challenged the underpinning of this science that claims that our oil and gas are creating a climate catastrophe.” Morano, Marc (Climate Depot)Morano says Barack Obama came into office and made it worse – and he contends the current administration needs to shoulder some blame as well.

“The Trump administration has not challenged the endangerment finding that the Obama administration implemented that says carbon dioxide is a danger to our atmosphere,” says Morano, “[and] the Trump administration has not yet appointed a presidential commission to reexamine the science.”

Because of that, Morano asks: “Who can blame a judge?” “It’s amazing more judges haven’t come to this ruling,” he continues. “The time has come to officially start challenging the scientific claims of the United Nations and pushing back on this nonsense – and until that happens, I’m not even confident that, if this goes to the Supreme Court, it will go our way at this point.”

Steve Milloy: EPA regs based on ‘illegal and scientifically bankrupt endangerment finding’– Statement from Steve Milloy’s JunkScience.com:

“The Clean Power Plan was based on the Obama EPA’s illegal and scientifically bankrupt endangerment finding.

The Obama EPA made up its mind to condemn CO2 before the endangerment rulemaking began, ignored the ongoing global warming pause and then finalized the finding despite the shocking Climategate emails confirming the scientific corruption of the climate alarmists.

Particularly galling was the Obama-invented “social cost of carbon.” In reality, there is no social cost of carbon because without fossil fuels, society stops.

Ironically, the Obama Clean Power Plan was not justified on the basis of reduced CO2 emissions but on the “co-benefit” of lives saved by reduced particulate matter emissions. The notion that coal plant particulate emissions kill people has now been totally debunked. So the Obama Clean Power Plan has absolutely no legs to stand on.

Kudos to Donald Trump and Scott Pruitt for keeping this vital campaign promise.”

The number of factors that influence climate—the sun, the earth’s orbital properties, oceans, clouds, and, yes, industrial man—is huge and enormously variable,” Happer said.

They deny the hundreds of causes and variables that influence climate change and instead try to pretend that carbon dioxide is the climate control knob overriding all the other factors and that every bad weather event is somehow “proof” of “global warming” and an impending climate “emergency.”

Here is a deep dive into what’s causing the higher gas prices. And no, it’s not supply and demand… it’s the government regulation. EPA increasing fees then costs and regulation to the point that oil companies can’t stay in business. They must pass the cost on the consumer. And you haven’t seen nothing yet, new increases coming in 2023 to force the price even higher unless this supreme court ruling changes all that.

HEAR YE, HEAR YE Democrats, you ARE the majority right left correct? I mean more than 50% of the population buys into your pontifications correct? You have the power to end oil without legislation by simply not using anything produced by it.

Simply…
Have your functioning gas stoves removed and replaced with electric.
Have your functioning gas heaters removed and replaced with electric.
Have your functioning gas water heaters removed and replaced with electric.
Trade in your Gas or Diesel powered cars for new Electric Vehicles.
Have 160 KW of EV quick charge battery storage mounted inside your garage.
Have sufficient Powerwall battery back-up to supply your home needs during a blackout
Have sufficient Solar Panels mounted on your rooftop to recharge all those batteries.

Though you’ll probably be walking everywhere anyway since automotive and bicycle Rubber Tires require oil for their creation. As do Asphalt Roads, plastic wire insulation, lightweight plastic components, all needed for even EV efficiency and Wind Turbine weight reduction and associated efficiencies. And Coal for silica-to-silicon purification for Solar PV cell production.

And any of the other more than 6000 products dependent on Petrochemicals

Democrats, if you only stopped being hypocritical and ceased pandering to the Oil Industry your Utopia would be realized…without legislation.

You must have read the NY state “green power plan”. As of now, no gas is to be used in any new construction and, in the future: if your gas furnace, stove, or water heater fails it must be replaced with electric. No small gasoline powered tools will be allowed as of 2025. On and on and one. One stupid regulation after another, ad infinitum. Our guvernor woke-ul is as stupid as the day is long and, mistakenly, thinks that she rules our lives. Well, maybe not mistakenly – it seems that the voterds here are not self-sufficient and require direction if not domination.

Now if we could only get back to the Constitution’s notion of enumerated powers. Then most of the administrative bureaucracies can be liquidated because they lack an amendment that supports their activities. Plus, it would be great be to require all regulations to be ratified by Congress (because the bureaucracies represent unconstitutional delegation of legislative power and also because they violate separation of powers).

That is not so easy. CAA gave EPA discretion to circularly define pollutants ‘as that which pollutes’. So EPA accomodated Mass and UNFCCC by doing so after Mass v EPA.
There is a long, difficult, and for sure to be legally challenged theoretical way within the EPA.
The better strategy is to simply amend CAA by legislating that a gas vital for photosynthesis is NOT a pollutant at any level less than, say, that used in greenhouses to make stuff greener. That has a shot after the 2024 election given how poorly Biden is fairing.

No court could say otherwise.

The case of Obama’s Clean Power Plan was that it was done by fiat after a very similar law was rejected by Congress. The greens either do not have the votes or do not want their names on vastly increasing the cost of energy.

July 2, 2022 3:07 pm

There are lots of happy reports on the Supreme Court’s ruling throwing out EPA’s so-called Clean Power Plan. Some go so far as to suggest that EPA is barred from regulating power plant CO2 emissions.

It is not quite that simple and the result is rather amusing. EPA is still required to regulate CO2 under the terms of the Clean Air Act, but that Act provides no way to do that regulation. The Clean Power Plan attempted to expand an obscure minor clause in the Act to do the job but SCOTUS correctly ruled that the clause does not confer that kind of massive authority.

EPA is between a rock and a hard place. It should tell Congress that it cannot do the job and needs a new law, along the lines of the SO2 law added to the Act in 1990, curbing emissions. But such a law has zero chance of passing in the foreseeable future.

EPA is stuck. What they will now do is anybody’s guess. Enjoy their dilemma!

The US Constitution does not care about science, does not care about policy, and does not care about ideology.

The Constitution is 100% about how government functions and the rights and powers of the three branches of the Federal government, the States, and the people.

The ruling was quite simple, as stated by the Chief Justice:

Only Congress can set policy by enacting laws. The Executive cannot make policy, but only faithfully execute and administer the laws. SCOTUS ruled that EPA unconstitutionally usurped Congress’s powers.

If the warmunists want to make warmunism the policy of the United States, then they will need to convince Congress to enact laws to do so, and convince a President to sign the laws Congress enacts. If they can’t do that, then they are SOL.

“CO2 is not a pollutant, humans inhale oxygen and exhale CO2. Humans are not ‘pollution.”

Breathing – Wikipedia (under composition.) “Inhaled air is by volume 78% nitrogen, 20.95% oxygen and small amounts of other gases including argon, carbon dioxide, neonhelium, and hydrogen.[16]
The gas exhaled is 4% to 5% by volume of carbon dioxide, about a 100 fold increase over the inhaled amount. The volume of oxygen is reduced by a small amount, 4% to 5%, compared to the oxygen inhaled. The typical composition is:[17]

Imagine what a government agency that can regulate CO2 could do with this saying “…humans exhale about a 100 fold increase over the amount inhaled amount.” The human population in 1900 was around fewer than 2 billion people and today are 7.7 billion (close to a 5.5 billion increase) people that breathing exhale some 100 fold more CO2 than they inhaled. In a world that less people die than are born and live, the human population growth contributes a high amount of the CO2 increases as part of the Natural Carbon Cycle.

In a technical sense, the EPA never had their own authority to regulate CO2. Lest anyone forget, Steve McIntyre was exposing the fatal fault in the U.S. EPA’s efforts to make pronouncements about CAGW, via his detailed criticisms about how the core IPCC people refused to share their temperature/weather-gathering data. In his June 2009 blog post, McIntyre said (3rd paragraph https://climateaudit.org/2009/06/23/climate-audit-submission-to-epa/ ):

 — “EPA guidelines require that highly influential scientific assessments meet a variety of sensible standards for transparency, data availability and due diligence – policies that CA [ClimateAudit] readers know not to have been implemented by the IPCC.”

Quite likely that if there was anybody in EPA at that time to call out this massive problem, they might have feared losing their job or feared being reassigned to work in some forgotten corner of the agency.

We still have an ongoing enemy of humanity out there. The response to this ruling by the Warren’s, AOC’s Kerry’s Schwab’s Gore’s the entire Hockey Stick team, plus the current administration’s puppeteers, who are still pulling the strings, tell us, we have to keep up the resistance. These modern day Luddites do not stop.

Even some in Europe are getting militant now. And I mean really militant.
I’m not sure that crap is going to fly.

The Supremes basically said:

Before you break the Constitution
