Washington Times: Despite denials, count on Biden-Harris to direct AG to do their scandalous bidding

With a potentially bruising Department of Justice confirmation battles looming, both Joe Biden and Kamala Harris now vigorously deny that they would ever direct their Attorney General to do their political bidding or target specific opponents. This would be unremarkable, had they not promised the opposite with equal vigor – and disturbing specificity – during the 2020 campaign.

CNN reports Biden saying in an interview, “‘I’m not going to be telling them what they have to do and don’t have to do. I’m not going to be saying, ‘Go prosecute A, B or C.’ I’m not going to be telling them. That’s not the role. It’s not my Justice Department, it’s the people’s Justice Department’. … Harris echoed the sentiment of Biden’s remarks on the Department of Justice. ‘We will not tell the Justice Department how to do its job,’ Harris said.”

So pay no attention to their unambiguous promise to weaponize DoJ: “Biden will instruct the Attorney General to” do all manner of things to impose a political agenda or target opponents, including, “(iii) strategically support ongoing plaintiff-driven climate litigation against polluters”.

The latter point of course refers to an expanding litigation campaign by activists and the tort bar to force the progressive’s “climate” agenda on the country, and to enrich themselves through what are in effect taxes paid by consumers, run through massive settlements with energy companies.

The plaintiffs’ team regularly admit that this is an attempt to use the courts as substitute policymaker for an agenda that keeps failing through the democratic process.

Their objectives are to “bring down the fossil fuel companies”, coerce defendants “to the table” and ultimately to enlist them as lobbyists for desired climate policies. That is, the idea is to substitute verdicts for the failure to enact policy by convincing the public.

Things will inevitably get confusing, therefore, should DoJ soon deploy the awesome powers of the federal government to assist political-ally plaintiffs, against perceived enemies of the climate. So consider some facts about this litigation campaign.

First, the Biden-Harris vow revives the plan to federally prosecute the “climate” opposition, as revealed in a 2016 colloquy between Sen. Sheldon Whitehouse (D-RI) of the Senate Judiciary Committee and then-Attorney General Loretta Lynch.

That was shocking. This is even more deplorable given it’s not just a uniquely obsessive senator egging on an AG with a suspect record of politicization; this involves a president and vice president vowing a political hit for political allies, whose clumsily synchronized backpedal only adds to suspicions.

And of course, there is no reason to expect the threat to deploy government in this way is just against whomever they decide is a ‘climate polluter’. The targets will be wide-ranging, as Whitehouse suggested.

I spent two decades with the Competitive Enterprise Institute (CEI), a consistently effective opponent of the “climate” agenda which, therefore, found itself the subject of a subpoena campaign in an early, coordinated assault among state, DC and even territorial attorneys general.

That campaign resulted from an infamous call in 2011 by the same activists and tort lawyers for “a single sympathetic attorney general” to go after private parties with investigations, in order to extract records for use by the “climate tort” bar.

Thanks to newly released records, we now know that an ambitious young state AG from California helped organize this coordination between tort bar and law enforcement.

Bringing us to today, with that same ambitious lady having confessed that, if elected Vice President, she will direct the Attorney General of the United States to take over. And also that she would never ever do that.

Washington wouldn’t be The Swamp if the AG who subpoenaed CEI and 100 others, the U.S. Virgin Islands’ Claude Walker, wasn’t recently, quietly installed at the U.S. Environmental Protection Agency as deputy director of criminal enforcement. Don’t you just love it when a plan comes together?

Biden-Harris ran for office with a very specific, deplorable promise of weaponizing the Department of Justice on behalf of friends’ private civil litigation, to compel fealty to a failed ideological god and punish the heretics.

Soon they will turn to putting a “sympathetic Attorney General” in place. Confirmation hearings must confront this overt promise, generally, and detail this specific scheme by the climate litigation industry to occupy law enforcement offices.

Recall that billionaire activist and major Democratic donor Michael Bloomberg has already “embedded” privately hired attorneys in progressive state AG offices as “Special Assistant Attorneys General” to push this agenda. As the government-transparency group Energy Policy Advocates recently detailed, these mercenaries also were immediately tasked with assisting these private plaintiffs’ suits.

We have learned that this campaign’s lead tort firm has received “grants” of millions of dollars from a charitable foundation, plainly to underwrite its work despite contingency fee agreements promising massive payouts from any settlement. This is seemingly problematic, and not just for the poor optics of double-dipping.

We have also learned of “climate” plaintiff Rhode Island – home of Sen. Whitehouse – confessing that their goal in is to obtain a “sustainable funding stream” because the legislature would not pass the taxes required to finance left-wing spending ambitions.

The Biden-Harris vow to order their Attorney General to enlist the Department of Justice in this troubling campaign is scandalous. The Attorney General confirmation hearings must elicit from the nominee an unambiguous condemnation and disavowal of such thuggery.

Not trying to be sarcastic, but apparently only Leftists and non-citizens have standing in the corrupt courts now. Not even the President of the United States, not members of legislatures, not candidates for office suing over a stolen election seem to have standing, so it doesn’t matter what evidence they want to present. The court will cancel an evidentiary hearing and then dismiss the case for LACK OF EVIDENCE ….but illegal aliens breaching our borders and unlawful combatants captured on a battlefield in Afghanistan or Iraq DO have standing in U.S. courts. It might help for anyone wishing to bring suit in a U.S. court to set off in IED or a car bomb or set a business on fire first or dress in the latest BLM and Antifa fashion and wave the flag of your favorite foreign banana republic to gain standing.

If alarmists launch such a broad legal assault, it would probably backfire on them, since “The Science” is not necessarily on their side, or in their pocket, as some of them seem to believe. It would force a public debate on “The Science” that the alarmist side may very well lose, at least in the eyes of the public, who’s generally not inclined to believe that climate issues are an emergency, or even a real problem, after decades of unsubstantiated claims and falsified predictions.
The fact that for years alarmists have been avoiding public debate speaks for itself. You don’t avoid a public debate if you think that you’re in a position to crush your opponents.

When the legal fix is in, science won’t matter.

They’ll be show trials, with plenty of consensus climatologists on hand to hotly testify against the defendants at the bar, including against any scientists who dispute (or disprove), the IPCC position.

The court will accept the testimony of the AGW people as climate canon. Everything else will be dismissed as lies, propaganda, or, at best, mistakes.

Consensus climatologists are incompetent, and so will actually believe the pseudo-science they spout. Their sincerity will be taken as proof for their testimony.

The Earth would appear to already be below the ‘ideal’ 14degC temperature, Yesterday I posted the same site and it was 13.99degC now it is 0.01degC lower. So following the climate ‘science’ approach of projecting from that change, the world could be 3.65degC colder than it is now in a year’s time. Difficult to get people fired up about global warming if that happened.
(Although I would expect a smooth volte face to Anthropogenic Global Cooling needing to stop the use of fossil fuels to prevent a drop into glacial temperatures)

You seem to be under the impression that the courts are honest and ethical. The kangaroo courts that refused to let Trump’s lawyers present any information of fraud would say otherwise.

This country is done, it is over. Emboldened by getting away with fraud in the presidential election, the fraud was now repeated in the Georgia senate election. If you think the Republicans will re-take the house in two years, think again. Fraud will prevent that as well. And since the courts are no longer about justice, the fraud will succeed. President-elect Harris will then add two supreme court justices that will vote the “correct” way every time. In November, the Supreme Court ruled 5-4 vote saying governor’s executive orders do not override the Constitution. The 4 dissenting judges said it was an emergency, so it was okay to suspend the Constitution. All the democrats have to do is declare another “emergency”, such as a climate emergency, and then by a 6-5 vote our rights will be suspended.

Once the United States falls to the globalist and Marxists, the rest of the world will be right behind. Things are going to get really bad soon.

The House is populated based on elections from each of the 435 congressional districts. The Democrats are very successful at getting large blocks of votes from cities which can carry a state-wide election. They are not able to garner the votes from all the outlying districts which primarily vote Republican. That’s why in the 2020 election the Democrats lost seats in the House and will almost certainly lose control in 2022.

Tim Ball won against Michael Mann, didn’t he?
If I remember correctly, he won because the Canadian court asked Mann to present the data that he used as basis for his theory, and for several years, Mann chose not to show this material.
One can only guess why Mann chose to lose this libel suit against Ball. I doubt that was his intention when he filed it.

The burden of proof is on the side that sues, and in this case it would be hard to prove something in court that no one had been able to prove outside the courts.
Judges are not stupid journalists or corrupt editors, and they know that if they fail to do justice, a higher court can overturn their verdict, make them look bad, and hurt their career.

I find it hard to imagine that any prosecutor could prove beyond reasonable doubt that an expert testimony provided by someone like Will Happer, Richard Lindzen, Nir Shaviv, etc. is scientifically invalid.
All that would be required from the defendants is to show that there is a legitimate debate within the scientific community, and that it is acceptable not to side with the alarmists’ point of view and predictions.

The only benefit of this is that it will force them to have to prove something, which they haven’t done so far, and will have to respond to all the evidence that shows they are wrong. The risk of a jury trial concerns me, but good attorneys should be able to deal with that.

I would not pin any hope on evidence. A morally straight-laced, law-abiding, unbiased, learned lawyer and his team could present the evidence plain as day and incontrovertible but activist judges will simply force a certain outcome regardless. The courts would act more like courts in post-WWI Germany where it’s just a chance for a predetermined conclusion to build up its legal clout. Evidence is irrelevant unless it supports the predetermined conclusion.

The NTs were actually for people who had committed horrible crimes.

As I write this, it appears that both of the Senate seats for Georgia will go to the Democrats. With VP-elect Harris casting a tie-breaking vote in situations where a vote on a bill follows party lines in the Senate, the Democrats can likely do whatever they want.

Thus, we have a situation where The State and the climate-religion become one in violation of the U.S. Constitution. With no one in a position of significant power or influence having taken on the challenge of exposing it as as a type of religion, there is nothing to stop the The State from repeating the history of the Salem Witch Trials or Nuremberg trials as the post above suggests. Let the witch hunts begin.

One might think that we as a species have psychologically evolved enough and have become enlightened enough to where we are beyond the point that something like this could happen again after over 400 years. You might very well be wrong. Lysenkoism….science is just an instrument that now serves The State. I pray that I am wrong about all this, but I fear I won’t be.

Not just businesses. If you have an above average income, you will need to start working on ways to protect your income for the coming tax increases. The Democrats claim that they are only going to tax the wealthy, but that’s a lie. In order to get the kind of money they need, they are going to have to tax deep into the middle class.
You can also expect attempts to raid retirement funds. After all it’s not fair that some people have enough money to retire, while others don’t.

Most WUWT readers might already know there are “ExxonKnew”-style global warming damages lawsuits currently filed in the U.S., but might not be aware of how many. By my count, there are 23 of them, the majority of them being handled by just one single law firm with possibly suspect ties to one of the central promulgators of the almost 30 year-old false accusation that skeptic climate scientists are paid fossil fuel industry money to lie.

It is called plausible deniability and is used often by politicians especially on the left such as the Clintons and the 0. Doesn’t seem to work so well for conservatives though. The corruption of investigative agencies and the judiciary becomes more obvious daily. I recall Nixon was denounced for having an “enemies list” but Mad Maxine blabbed about the 0 compiling such a database with impunity. 1. We must not allow the alarmists to blame climate change on the the fossil fuel producers. We must shift the blame to the end user. In general the neo marxists are looking for victims they can lead against a perpetrator. We must make the victims the perpetrators.

2. Closely related to the above. We must hold leaders accountable to the laws they create. Actively campaign against any judge or lawyer who owns an ICE car or boat, has a holiday house or fly overseas for a holiday.

After the COVID-19 scare and the coming COVID-21 scare (Id say sometime in February/March), the climate which hunt will begin in earnest. The next 4 years are going to be interesting for the USA under Biden (Who won’t be PotUS for long IMO) and the world. But what is being ignored in the media is the tensions between the US, Taiwan and China in the Taiwan straights.

Biden is China’s man in DC. He’ll probably go easy, possibly withdraw the US Navy, and say something like, ‘It’s time for us to face reality.’ Taiwan will be left in the wind.

If Biden wins then every heresy will be on trial. Everyone who will dare to disagree with the left’s owners (media, tech, CIA+lawfare, med-mafia (pharma on top)) will be “re-educated”. The excuse will vary depending on their needs but climate will be one.

It will be longer than 2 years. Even if the Republicans are able to over come the cheating, they won’t have enough votes to overcome president Harris’ vetos. So everything passed in the first 2 years will remain for at least the next 2.

For those Americans that haven’t figured it out yet. We no longer live in a representative Republic. The United States is now an Oligarchy and under such a system the Constitution is nothing but an old scrap of parchment. Under such a system there are no limits on the punitive actions the elite can take against those they believe threaten their power and wealth.

So as for the question the answer is YES if it serves the purpose of our rulers.
