President Donald Trump’s first step toward pulling World Health Organization funding during the coronavirus pandemic has set the stage for another legal tug of war with House Democrats wary of him treading on their power.

“This decision is dangerous, illegal and will be swiftly challenged,” House Speaker Nancy Pelosi said in a statement Wednesday. 

The party also raised the specter of the White House’s decision to withhold congressionally-approved military aid to Ukraine last year as Trump urged the country to investigate his political rival, apparent Democratic presidential nominee Joe Biden. The action led to the House impeaching Trump. The Senate acquitted him in February. 

“In a desperate attempt to deflect blame, President Trump is violating the same spending laws that brought about his impeachment,” House Appropriations Committee spokesman Evan Hollander said in a statement. “The President does not have the unilateral authority to withhold the United States’ assessed contribution to the World Health Organization.”

Reading the Impoundment entry on Wikipedia, it seems likely President Trump can only delay funding for the WHO for 45 days – a longer delay requires approval by both houses.

Presidents used to have the power to unilaterally cancel wasteful expenditure. The power was first used by President Thomas Jefferson to veto the expenditure of $50,000 on gunboats.

The Presidential power to permanently veto funding was removed under President Nixon in 1974; the Democrat Congress was incensed that Nixon kept using the impoundment power to withdraw funding from their bills, and used the Watergate scandal to pressure Nixon into approving the restriction of Presidential authority to withhold funds.

A few years later US National Debt started ballooning (see image at the top of the page).

President Clinton attempted to introduce a similar power, a line item veto, but quickly lost that power when the line item veto act was challenged and overturned in the courts.

Vuk – Belgium has highest reported death rate of the EU – only 3rd highest among countries reporting. Here are the numbers in reported deaths/M population:

If you analyze the 60th parallel countries/states data for deaths / M pop, the average (x) is 30.3 and standard deviation (y) is 42.6. The Swedish data of 132 deaths / M pop is ~2.4 standard deviations higher than the average of these 8 northern-tier countries/states.

You are correct. Impeachment is a process. The House develops and presents the Articles of Impeachment to the Senate which then holds an Impeachment Trial based on said Articles.
In this case the Senate acquitted the President, so he was never Impeached.
They stopped teaching Civics in American schools a long time ago…

Article I, Section 2, of the Constitution: “The House of Representatives shall chuse [sic] their Speaker and other Officers; and shall have the sole Power of Impeachment.”

Impeachment is the equivalent of an indictment, or pressing charges by the House of Representatives. Once a person has been indicted, he goes to trial (usually). If found not guilty, HE STILL WAS INDICTED. The same holds for impeachment. Three US Presidents have been impeached, Andrew Johnson, Bill Clinton, and Donald Trump. None were found guilty by the Senate, and retained their offices. This in no way means they were not impeached because they were found not guilty.

Article I, Section 3, Clause 6: “The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.”

Nope; Trump was never impeached. Just because Pelosi says impeachment procedure was started doesn’t mean it was; the impeachment itself is a hoax.

Trump had to play along with the hoax, but there was never an impeachment, and there were no charges anyway, so it’s a double hoax.

Also, Pelosi tried to negotiate the process with the Senate, which would have been an obstruction of justice if there was a real impeachment. Also, what Pelosi did was an abuse (actually, multiple abuses) of power. Pelosi should be impeached.

Also, trying to get candidate Trump’s taxes is another abuse of power; and those who tried should be impeached for that.

You misunderstand what the word means. Look it up in any dictionary. It means to accuse or to charge. It is the political version of filing charges or an indictment in a court of law. Therefore, Trump being “impeached” is a fact, as the House of Representatives voted to impeach him on two Articles of Impeachment.

This is little different than getting a traffic ticket. Charges by the officer with breaking laws are detailed on the ticket. If the charges are later dropped, or you are acquitted in Court, you cannot say you were never charged with a traffic offense. Being charged is a fact whether or not you are guilty of the charge.

This is no different than the TV show “Law and Order”, where the first half is the cops and prosecutors finding the evidence to press charges or indict. They do so believing they have enough evidence to convict. Either way, the person is IN FACT charged with a crime, or indicted.

Once the charges or indictment are filed with the Court, the process of going to trial is started. An impeachment follows the same track.

Once the House files the Articles of Impeachment with the Senate, i.e., the Court, the process of going to trial is started. The Senate has sole authority to TRY the case, i.e., the charges filed in the Article(s) of Impeachment. The Senate acquits or convicts.

Either way, the person was impeached by the House. Trump was impeached (unfairly, in my opinion), as was Clinton, and Andrew Johnson. You will not find a single history book that says Johnson and Clinton were never impeached because they were acquitted by the Senate.

Like being indicted and found not guilty at trial. In our system of law, you are assumed to be innocent until proven guilty in a court of law, not the court of opinion. So President Trump is innocent of the charges brought against him by the House. So from one POV, this reflects badly on the House because it means their case was weak/flawed; their carried the burden to prove their case and did not.

Trump was guilty only of doing his duty to investigate US crime in Ukraine, as per the treaty signed by Clinton.

Clinton, OTOH, was guilty of perjury and obstruction of justice, but, for whatever reason, wasn’t convicted by the Senate. Also of bribery and treason, but not indicted, ie impeached, on those charges.

President Trump wasn’t even allowed to face his accuser. That is the basic principal premise in law, that an accused has the right to face his accuser. We don’t even formerly know who that accuser is, therefore is this ‘impeachment’ even a legal one? I think history will say this was a sham impeachment. In reality, it actually exposes VP Biden and his son Hunter, as the actual corrupt ones in Ukraine. Including what happened in China, which is yet to come out yet fully what happened there with a $1.5 Billion hedge fund investment for Hunter after flying to China on Airforce 2 with his father, the VP at the time. Talk about real corruption!

There is nothing about the impeachment-removal specified in the Constitution that requires Congress to apply the legal standards of Due Process and of the Right of the Accused to challenge witnesses’ testimonies and evidence presented. The Constitution specially allows each chamber to set its own rules on their respective process and procedural rules.
Members of Congress can openly discuss their opinions and how they will vote before any evidence or procedure has been conducted. We see this everyday with Democrats calling for Trump’s impeachment and Removal. No jury member in a criminal or civll trail would be allowed to do that and remain empaneled. Federal judges that announce pre-judgements by the Rule they operate under (that do not apply to the Supreme Court justices) requires recusal.

In this regard, the Impeachment in the House is not like a Grand Jury indictment because only by tradition does the House of Representatives in their impeachment build the case that will be presented to the Senate for the senators to then consider for removal. The Senate is in no way required to do they House’s job in building the case against the accused.

This is where House Democrats royally Eff-d up with Trump’s Impeachment last December. They were in such a rush to get it done by Christmas Recess that they didn’t call all the witnesses and gather testimony to completely build their case prior to its presentation to the Senate. Thus there was much evidence that they later wished they could present in the Senate that they did not have directly becasue of their rushed Impeachment, and their desire to turn the GOP run Senate trial in a circus show, that Mitch McConnell very effectively kept his majority in line that then bitched-slapped the Democrats with their own ineptitude.

Impeachment-removal is thus an exclusively political process available to the the elected Representatives of the People to remove an abusive Executive, or any officer or judge-justice in the Federal government. It offers no other remedy than removal from office. Any criminal or civil actions from then would then be carried out as they would for anyone – with Due Process and the assumption of innocence until established as guilty beyond a reasonable doubt (criminal conviction standard).

If they actually had additional evidence they have had at least three months to bring it forward, even if just for political purposes.

The fact that they haven’t done so leads to a big question mark as to whether they actually had anything else to present.

Trump pretty much erased their accusations when he released the transcript of the Ukraine call. The Democrats never got over the hump that put in the road to convicting Trump.

Impeached? Yes.
That’s the first step for Congress to remove a President from office.
The House of Representatives is only 1/2 of Congress.
Today’s House, suffering from severe TDS (Trump Derangement Syndrome), voted to impeach.
The more usually more stable 1/2 of Congress, The Senate, said, “What for? Prove your case.”
He was not removed from office. (As Johnson and Clinton were impeached but not removed from office.)
The Dems’ in the House TDS becomes more and more acute with every day Ginsburg ages.

It looks to me that they won’t be able to impeach President Trump if he releases the funds on day 45. There may be a way to further the delay of funds to W.H.O. Release them with instructions to send it by mail, $1.00 at a time.

The sum total of the funds are released and on their way. It’s just the receipt of funds that will be spread out. What’s wrong with that? I didn’t see anything specifying when the funds must be received. I did see black and white instructions that they must be released in 45 days.

Meanwhile, at the burn rate of typical WHO expenditure, even a 45 day delay releasing the funds will hurt a bit. It will also take a while, about 1,368,925 years for the allocated amount to reach W.H.O., but ‘who’ cares?

The problem there is the 45-day vote is an affirmative vote to allow the impoundment to continue. In the absence of such a vote, the impoundment must terminate. She simply wouldn’t call it to a vote, thus the Executive would have to terminate the impoundment to remain in compliance.

Terminate the impoundment on day 45 and start sending the money at the rate of $1.00 per day. Then declare, “The funds are released and the spigot is open”. Might be a little clog in the spigot, but it meets the requirements.

According US Democrats, Trump has so much influence around the world, by not acting sooner he caused the massive early epidemics in Italy, Iran, and Spain. He is even so powerful as to have somehow caused the early spread in South Korea. Yes, if they want to Blame Trump for the US epidemic, then they have to blame him for the earlier ones in other countries to remain logically consistent.

But then no one has ever accused US Democrats of being logically consistent in their politcally-motivated accusations.

Such is the nature of adversarial democracies, but when the issue is fairly black and white such as this issue with WHO, most rationale people see that they have been ‘purchased’ by China in one way or the other and that their actions (both WHO and China) did major damage to world health and the economy. It is just so glaringly obvious. I think it just cements in the minds of a lot of people that what and how the Democrats operate has turned themselves into a sham, opposing anything and everything that President Trump says or does just doe the sake of opposition. I wouldn’t be surprised to soon see a ‘Democrats for Trump’ movement start to spread, just because the Democrats are clearly off the rails and I think they know it, which explains this bizarre irrational behaviour.

I think history will be much kinder to President Trump, when the actual subject matter is explored, rather than petty adversarial politics that is being advanced by Nancy Pelosi and the Democrats, which is further based upon petty character flaws that most of us have which can be exploited in the public forum of democratic politics. Depending how things unfold the next half year and the election, I think history will regard President Trump as a major transformational President, the likes of Ronald Reagan and maybe even much greater than that. He has clearly put the American citizen first, as was his main promise.

At least no one, even the Democrats, can accuse DJT of not fulfilling, or trying to fulfil the election pledges he did make and is still making. In that regard, he probably has been more truthful as a politician in the big picture of things, than most actual politicians have ever been. Which is why the Democrats are just shooting themselves in the head with this nonsense about not reforming WHO which is obvious to anyone that is paying attention. Director-General Tedros Adhanom must be FIRED, replaced and WHO reformed to be an agency for the good of the world, not to be bribed by China. Then funding might be restored.

President Trump, most Republicans, and some Democrats want to refund it immediately but Pelosi has refused to recall Representatives to the House to take immediate action on this. Instead, she is pushing for nationwide mail-in voting, ballot harvesting, and other measures designed to corrupt the American election processes and make it easy for illegal aliens and other unqualified people to vote illegally. She intends to get these profoundly corrupt measures included in any bill that refunds the SBA loan program! Impoundment is an act by a President of the United States of not spending money that has been appropriated by the U.S. Congress.

Trump has already said that does not intend to not spend it, he will just circumvent WHO kleptocracy and find more direct routes to where the money needs to be spent.

Sounds like a great idea whether WHO wants to reform or not. Win-win.

I apologize if this is off topic, but the numbers at https://en.wikipedia.org/wiki/Template:2019%E2%80%9320_coronavirus_pandemic_data/Mainland_China_medical_cases_chart still don’t look right. 82692 deaths is a lot more realistic than the 4000-or-so being reported as recently as this morning, but the decline in daily change seems to rapid and orderly.
The NHC page lined beneath the numbers (http://www.nhc.gov.cn/yjb/pzhgli/new_list.shtml) doesn’t have an item that contains the numbers or a reference to them. We don’t seem to have the whole story yet.

Desperate times call for desperate measures and Pelosi and the gang will sacrifice anyone to try and gain some political traction at this point. The more desperate people the better in their book. They will extend this economic shutdown for as long as they possibly can as long as they believe it is to their electoral advantage. In their minds the ruination will only create more people dependent on the government and that is who they target as the bulk of their voting base.

Each earlier attempt to impeach Trump failed for lack of evidence. Now they are left with extremely thin gruel. Compare these charges (withholding funding to an incompetent and biased WHO) with some of the actual crimes committed by previous presidents and vice-presidents: cheating on taxes (Agnew, VP), covering up the Watergate break-in (Nixon, Pres.) perjury and suborning perjury (Clinton, Pres.), hiding all her emails on an illegal server (Mrs. Clinton, Sec State, included because this was so egregious, even though she was not president or VP), and Trump for winning. Agnew and Nixon resigned before the House began a formal procedure. Both Clintons were clearly guilty. President Clinton was impeached by the House of Representatives but was not convicted in the Senate, which requires a 2/3 vote. H Clinton was never even charged for crimes that put several other people in prison for significant sentences or forced to resign their position, although they committed one or two counts. She committed one count for each e-mail that she moved off the official government network onto her private and unsecure server. They have discovered tens of thousands of emails, some with highly sensitive information. The attack on Trump has nothing to do with innocence or guilt, and everything to do with his election in the first place. It’s the liberal establishment power brokers’ own fault – they supported a candidate that had too much baggage to win. This attempt to impeach him will just push some more people in the middle to vote for him. Sadly, I will have to vote for him – as dumb as he is, he’s better than the other option.

Wrong. It failed for lack of charges. Also, lack of a impeachment procedure lawfully started. Pelosi has no power to declare an impeachment. There was no impeachment, and no charges anyway. It’s a sham.

Cabin fever and fears about what CoViD could do to the vulnerable population elsewhere in China did the rest.

Forty-five days is about all Trump needs. What Trump wants is for WHO Director Tedros to resign and the WHO agrees to major reforms.

Trump’s “cutting all the money” is part of the “Art of the Deal”.

I don’t think Trump is the only one unhappy with the WHO. The UK and others have been grumbling. Tedros should go find himself a good job in China. China’s leaders need practiced propagandists and I think Tedros qualifies.

The Impoundment Control Act is a farce. The only remedies are bureaucratic and civil. Failure to comply with the Act is not a “High crime or Misdemeanor”. It is not a crime of any sort at all.

Secondly, the act is unconstitutional, especially when it is applied to the President’s power to conduct foreign relations. Budget authorizations are just that, authorizations. They are not blank checks delivered to third parties. The President will often want to be authorized to give money to foreigners. Bribery of foreigners has been an important part of diplomacy since Classical Antiquity.

But, the BCA cannot possibly be construed to prevent the President from not delivering money to foreigners when the interests of the United States, in the President’s judgment require him to turn off the tap.

Thirdly, I think Nancy has a great idea. Impeach Trump for not sending money to anti-American toadies of the Chinese. She will prove that the previous impeachment was indeed a politicized farce, and she will ensure his landslide re-election.

The speaker of the house declaring the start of impeachment proceedings instead of having a vote as required. Not a single witness testifying publicly in the house and then the demand by the Pelosi and the democrats for public testimony by witnesses in the Senate except for the so called whistleblower accuser who’s identity they claimed must be protected at all costs.

My view. Perhaps someone who knows more about the legality of appropriations knows better but it does not appear that the Dems have any standing on this one.
The 2020 Appropriations bill H.R. 2839 never mentioned WHO as a Congressionally directed funding target or required contribution. WHO would be typically rolled under the $1.52 B funding for “International Multilateral Organizations.” POTUS has wide latitude to conduct foreign policy and to distribute any supporting funding. Democratic assertions that his action is illegal and impeachable is likely specious.
Another impeachment hoax??
