Unfortunately, previous EPA lawyers convinced the Supreme Court that CO2 was a pollutant and therefore could be regulated by the EPA. It just goes to show how gullible and lacking in common sense intellectuals, like those on the Supreme Court, can be. Pruitt can change current EPA policy, but he can’t reverse a Supreme Court ruling. So, the next Democratic administration can reinstate CO2 regulation policies based on the SCOTUS ruling. Only Congress can prevent it by rewriting the laws that govern the EPA and make it clear that CO2 is not to be considered a pollutant.
My understanding is SCOTUS told the EPA it was the EPA’s job to determine if something is a pollutant and how to minimize its impact.
I don’t think SCOTUS would take it upon themselves to make a scientific determination like establishing pollutants as defined by the US Constitution.
The only thing the Supreme Court did was to say that the EPA had the power to classify CO2 as a pollutant. They never ruled on whether or not it really was; that’s not their place.

With reference to the release of CO2, the NASA site lists deforestation before fossil fuels as the cause, suggesting the former is more important. So why is this not taken up by the media, politicians etc and how many trees have gone exactly?
I think I can answer my own question. All the forests are in developing countries.
Where they fell trees for fuel and to clear land for farming, because we in our infinite First World wisdom would exclude them from the hydrocarbon revolution. 😐
I think the term “dismisses climate change” should be dismissed.
No one here has denied that the climate changes on a recurring basis. It just does not happen quickly, nor does it have anything to do with so-called greenhouse gases or the amount of CO2 in the air. The planet has its own agenda and there is not a cotton-pickin’ thing we can do about it, except keep the place clean, because we are just along for the ride.
If this is a bump or hitch in the road to ruin, and will stop it before it goes further, fine by me. I’m hoping the cycle of unhealthy political idiocy is coming to an end.
Now if we can just convince the ecohippies that cleaning underbrush and trash/dead trees out of forests is a benefit and will reduce forest fires, that would be even better. I know firefighters who despise those people because they are so dead set against any kind of management to reduce fires that they cause more problems than ever existed before.
It actually can happen quickly. There’s just no evidence of a human-caused catastrophe. What they should have said was “is dismissive of climate change alarmism.”
Just a reminder, if the Democrats regain the majority in the House and the Senate they will begin to at least try to reverse all of these actions by Pruitt. They will also make every effort to get rid of Pruitt. If they do then they will delay confirmation of anyone they don’t like for as long as possible so the technocrats can regain power in EPA.
We don’t want the Democrats to regain any majority. The future of the nation is at stake. People should get out and vote if they value their personal freedoms because the Democrats are bound and determined to take them away. They think they know what is best for you and it’s too bad if you don’t agree.

What you are saying is correct and I have pointed it out before here at WUWT. However there should be one mitigating factor that will hamper future progressive socialist executive actions at not just the EPA but most of the various executive departments and agencies. That is the legacy Trump will leave in the Judiciary. Every person who believes in personal liberty and separation of powers, and states rights, as intended by the founders and expressed in the Constitution should be praying that this POTUS gets a second term and a Senate in which the democrats are too weak block or delay his judicial appointments.
When President Trump took Office there were approximately 140 various judicial positions for him to fill. I believe he has appointed approximately 40 new judges since he has taken Office, despite the Democrats obstructing the appointment process at every turn.
But today Senate Majority Leader Mitch McConnell said he would prevent the Senate from adjourning in August so that they could get their work done before anyone can go home.

As an outsider from the UK who was horrified at both Trump and Hilary being POTUS candidates, I feared the worst when Trump was elected.
Within months, however, I changed my tune as I watched him systematically begin to implement his pre election manifesto, and I wondered why no British politician since Margaret Thatcher has had the courage to get on with the job.
I don’t think he’ll have a problem come his next campaign as there are many Americans critically watching his progress and the worst they can say is that his policies might be wrong, but at least he’s doing what he promised, and more. Who else has flushed out N. Korea, who else has treated his country as the profit making enterprise it truly is, like every other country in the world.
Someone has to start doing something about the global debt culture, perhaps he’s the start. Announce steel tariffs, then negotiate with individual countries to reduce them. There’s a big return in that and every country in the world will be jostling for preferential treatment.
He’s also just exposed the EU for what it is, a vindictive little organisation who promise ‘retaliation’, like Trump’s a naughty kid. This is how they have been treating the UK over Brexit without actually saying it, but their colours are now nailed to the mast. This is how those socialist, bureaucratic, petty minded politicians operate. I hope Donald kicks them right in the plums!
Interesting though, that unlike British politics, he’s taken a real run at the EPA. Here it’s, as always, the NHS used as a political football. I can’t recall the EPA ever having been the main target, which might be telling about the power they were wielding. But then I don’t read the US media so I guess I’m influenced by WUWT and some other sceptical blogs.
All I can hope is that our conservative party does the right thing with Brexit, tell Europe to take a running jump, and get back on decent terms with our historic allies.

EPA could do a lot better job of showing off reclaimed superfund sites and other reclaimed areas. Just don’t open up flooded mine tunnels and adits without real mining engineers around. I’ve seen some legacy sites that could have been remediated long ago with little effort but appeared to be kept as symbolic sites for propaganda purposes. How about a suggestion box?

It is not enough. Trump has tp put funding into science that shows sensitivity is low. Trumps tenure will last 8 years, science lasts for ever.
For all the ill-advised and stupid things Trump has said, his performance on the CAGW front has been magnificent and brilliant. But not quite perfect. A few additional goals to reach are:
o Eliminate the EPA “Endangerment” Finding for CO2. I’d prefer if Congress actually did this, passing a new bill that prevents the EPA worrying about CO2 forever. The bill should specifically shelve all current regulations about CO2. Short of that, Trump should act and at least eliminate the Endangerment Finding administratively, during his term in office.
o Send the Paris agreement to the Senate for ratification (it will fail, needing 67 votes) so that it cannot ever come up again if a Democrat gets into the White House
o Mandate public archival access to all non-classified remote sensing data collected by publicly funded satellites/devices. This data must be stored sans massaging by experts. Derivative datasets used in federal or federally funded research must also be archived online and publicly available (at no charge). If data is massaged, also archived must be the instructions about which original data were used/selected, and the exact method of adjustments/infilling/corrections.
o Eliminate duplicated departments or entities that model or study climate. Again, we may need Congress here. All climate and weather and ocean temperature efforts will be organized under NOAA (no more NASA or DoE or DoD climate research) which will become the one-stop US climate and weather shop. Restrict modeling groups to one official US GCM climate model that must be used for any publicly funded research. The US model may not participate in CMIP projects that participate in the IPCC. Either the gamers that write and maintain the model believe in their own work, or they don’t.
o Elimination of expectations of “privacy” or intellectual property rights stemming from any government funded research, remote sensing, data collection, or modeling, including computer code. All intellectual property belongs to the public. Again, Congress needed.
o Most importantly, withdraw the US from the UNFCCC, which will remove the US from the IPCC. We pay not one cent more for any IPCC activities, studies, mitigations or pronouncements. Included in this removal is the elimination of US bureaucrats from attending IPCC meetings or participating in any IPCC processes as part of their official duties. They may attend privately, on their own time, paying their own way, of course, with the understanding that their opinions stated at such meetings are those of a private citizen, not as American representatives. This withdrawal includes a requirement government research grants to academic institutions may not be made if the research is IPCC related.
Have commented about the endangerment finding before. Is a long process because must follow the CAA prescribed process. Will be open to much litigation taking many years. No sure outcome because of ‘consensus’ ‘science’. Better is to strengthen House and Senate majorities in 2018, then revise CAA. The present definition of a pollutant is circular, “that which pollutes”. Works for SO2, mercury, NOx, surface level ozone, particulates. Doesn’t work for CO2. Just shows how the CAA is being stretched beyond its legislative intent. That is best addressed by legislation.
For all the excitement in seeing a non-science rogue agency brought to heel and some common sense applied to it, I don’t think the agency’s main goals should include Promoting Energy Dominance and Promoting the Auto Industry. This sounds of-course for an Environmental Protection Agency, and will lead to the diluting of mission and bloating of the size of the agency.
Also, this agency should not be picking winners – why promote the auto industry and not the airline or train agency? How about none of the above and let them compete?
We have a Department of Transportation…do we not?
We have a Department of Energy…do we not?
Unless the aim is to fold all of these departments into one, let’s not expand their missions into multiple over-lapping layers of bureaucracy.

Definitely yes. The “ban” is for ardent eugenicists or depopulationists, F. Ross. DDT is a marvelous prevention for malaria. It was “banned” by edict of EPA head Ruckleshaus, June 1972. He ignored all scientific evidence & the inquiry by Judge Sweeny which had found DDT safe & non-carcinogenic, only 2 months previously.
It was a triumph of corrupt politics, backed by corrupt science, over human progress. Sound familiar?

The fact that the EPA was turning the Federal Government into “the enemy” in so many circles will certainly drive this even further. If heads are exploding now, they may have to find something else to explode. For certain they will need to attend a course on how to write a resume without using the words: Environment, Environmental, Sustain, Sustainability, Warming, Global Warming, and most of all Activist and Change.
I do not expect this being commented or mentioned by our beloved friends from the MSM except, if at all, in a very derogative manner.

I sent the pdf from EPA to several people, 2 of them refused to open it because it came from a .gov page, they said it was not secure because their computer security programs flagged it. Too funny!
