Washington's despotic lawlessness

We’ve had a “try and stop me” president who gave $500 million away to the U.N. climate fund without Congressional approval. Now we need one who will invalidate those actions.

Washington is out of control. Legislators, judges and unelected bureaucrats want to control our lives, livelihoods and living standards, with no accountability even for major errors, calculated deception, or deliberate, often illegal assaults on our liberties and on citizens who resist the advancing Leviathan.

These themes animate Republican and conservative politics because they are happening – regularly.

The Competitive Enterprise Institute is renowned for its annual Ten Thousand Commandments reports on federal rules. A scary but mesmerizing new analysis now maps how the Washington bureaucracy lawlessly imposes agendas that all too frequently contravene or disregard what We the People support, what is best for the nation, and even what Congress has enacted or refused to encode in legislation.

The studies’ author, CEI policy vice president Clyde Wayne Crews, analogizes the situation to the “dark matter and dark energy” that astrophysicists say makes up some 95% of the universe: the portion that we cannot observe directly, as opposed to the sun, moon, planets, stars, galaxies and gas clouds we can see.

“Regulatory dark matter,” he concludes, forms an equal proportion of all the rules and edicts that govern our lives. But it is “hard to detect, much less measure.” Indeed, his “map” is akin to early explorers’ depictions of North America – incomplete, but the best cartography possible with information currently available.

No one even knows how many Executive Branch agencies there are – estimates range from 60 to 438 – much less how many new rules they implement and impose each year. Officially, Crews says, they issued a staggering 3,554 new rules in 2014, while President Obama signed “only” 226 new laws enacted by Congress. Worse, of the 53,838 (!) formal final regulations included in the Federal Register from 2001 through 2014, only 160 (0.3%) received a “cost-benefit” analysis; we have no idea how the rest affect us.

Infinitely worse, this tip of the iceberg does not include tens of thousands of decrees issued in the form of:

* notices, bulletins, proclamations, circulars, guidance memos, and new or revised interpretations, policy statements and procedures;

* investigations, inquiries, warning letters, negotiated settlements to legal actions (often involving collusion between agencies and activist groups), explicit or veiled threats of legal action, armed agents raiding homes and businesses, or adverse publicity, coordinated with activists and the media; as well as

* blog posts, news releases, and emails or telephone calls to citizens or company employees.

All these actions have the force and effect of law. But few or none are covered by Administrative Procedures Act “public notice and comment” requirements, so they often escape scrutiny by courts, watchdogs and Congress. Many are supported only by “homogenized,” manipulated data; elaborate, imaginative or imaginary regulatory benefits; cavalier dismissal of costs; and no mention of benefits from the activity, chemical, energy source, industry or jobs being regulated, sometimes into oblivion.

EPA’s Clean Power Plan assumes that shutting down America’s coal-fired power plants – a tiny fraction of such facilities worldwide – can somehow stop climate change that is actually governed by numerous powerful natural forces over which humans have absolutely no control. The plan also assumes any global warming will be dangerous and ignores the many thousands who will be rendered jobless.

A “social cost of carbon” scheme concocted by a multitude of federal agencies makes the same faulty assumptions. It then hypothesizes every imaginable and illusory “cost” of carbon dioxide emissions – to forests, agriculture, water resources, “forced migration” of people and wildlife, human health and disease, coastal cities, ecosystems and wetlands. But it completely ignores every one of the obvious and enormous benefits of using fossil fuels … and of CO2’s immense fertilizing effects on forest and crop growth.

President Obama imposed both of these programs because Congress refused to enact almost 700 different cap-tax-and-trade and other climate bills. Rather than working with Congress to achieve at least some of what he wanted, Mr. Obama simply had his agencies issue decrees, as another way to “skin a cat.”

Where Congress has enacted legislation that the president dislikes – on illegal immigration or the Affordable Care Act’s employer mandate, for example – he simply tells his agencies not to enforce the “offensive” provisions. Meanwhile, Endangered Species Act rules are enforced with an iron fist against ranching, oil and mining operations, but ignored in the case of wind turbines and solar installations.

Under collusive sue-and-settle lawsuits, parties impacted by decisions never have an opportunity to speak or present evidence, or even be notified that a suit has been filed or adjudicated, until it is too late.

The entire system allows unelected, unaccountable government officials to decide winners and losers, and reward cronies and allies with taxpayer-funded grants and subsidies, while punishing critics and enemies. “Progressive” judges defer to “agency discretion” and give bureaucrats free rein to do as they please, even when the rules, decisions and decrees do not comply with legal, constitutional or scientific requirements.

No citizen, small business or even large corporation can possibly even know all these edicts exist, much less understand or comply with them. Moreover, at least 4,500 carry criminal penalties, many regardless of any intent to violate a rule or commit a crime – and “ignorance of the law is no excuse.”

Astrophysics explains the consequences. A black hole in the cosmos has squeezed so much matter into a small space that the unfathomable pull of gravity prevents even light from getting out.

The Washington, DC regulatory black hole exerts such centralized gravitational force that federalism, states’ rights, state and local laws and customs, and personal liberties increasingly cease to matter.

The federal Goliath now costs US families, businesses, hospitals and organizations over $1.9 trillion a year! That is twice the entire federal budget in 1981. It’s equal to the entire budget in 1986, nearly half the incomprehensible Obama budget for FY-2017, more than the budgets of all other countries except China.

“The champions of socialism call themselves progressives, but they [resist] every kind of improvement,” economist and political analyst Ludwig von Mises observed 72 years ago. “They call themselves liberals, but they are intent upon abolishing liberty. They call themselves democrats, but they yearn for dictatorship. They call themselves revolutionaries, but they want to make the government omnipotent.”

America’s “soft despotism” is light years from the atrocities and gulags of its infamous predecessors. But it is highly effective nonetheless. The same agencies write, impose, enforce and adjudicate the rules, and impose punishment for infractions. They work tirelessly and imperiously to “fundamentally transform” our nation’s legal, energy, economic and social systems – and keep our fossil fuels “in the ground.”

They impose edicts that would never be supported by the People or enacted by Congress, and that they rarely if ever apply to themselves. They lavish billions on allies, while denying funding and legitimacy to critics, siccing IRS dogs on opposition groups, and threatening civil and criminal “racketeering” actions against anyone who “denies” the alleged “reality” of dangerous manmade climate change.

They seek to ban fossil fuels, biotech crops and insecticides – even from Third World families suffering from abject poverty, rampant malnutrition and disease, and a near total absence of electricity. They do all they can to silence and punish alternative views, and even the notion that there can be alternative views.

For seven years, our “Try and stop me” president and administration have used and abused their powers to impose their agenda. What we need now is a “Try and make me” president, who will refuse to enforce their edicts. Who will use his pen, phone and power to review them, root out any fraud and abuse behind them, and defund and bury them. Who will work with Congress to restore the rule of law and our Constitution, economic growth, and the role of personal liberties, opportunities and responsibilities.

Cruz wrote the language that allowed obama to fast track the TPP without senate oversite, Cruz is a one world puppet and the one world people are the ones behind the man made global warming bs.

Hillary has a lot to learn in a short amount of time. A lot has changed from the old days of selling Presidential pardons and routing millions through the Clinton Foundation. In this day and age they could lose trillions wasting time on small deals like Presidential pardons.

They’ve learned how to game the system.
Furthermore, they have learned that this country creates immense wealth via the (generally) free market. That wealth should rightly stay in the pockets of those who created it. But this Administration especially has learned that there is so much wealth created that it can simply put Americans into debt for $20 Trillion, and the system doesn’t implode.
But there is a limit. At some point we will have Zimbabwe dollars. I suspect that will happen if any Democrat is elected in November. Otherwise, we have a fighting chance.

It may interest you to know that the 100 trillion dollar note was issued after another twelve zeroes had previously been deleted from the face value. So rather than 100,000,000,000,000, that note really represents 100,000,000,000,000,000,000,000,000.
Current value, about $2. And still falling. The collector value is greater than its purchasing power.
Once total inflation gets going, it becomes exponential. But like the Weimar Republic, it plants the seeds of its own destruction.
There’s still hope for the USD. But not a lot…

Obama and friends have effectively destroyed our economy and put up for sale, at drastically reduced prices, most of what the citizens of the U.S. own. It has been deliberate. If we can climb out of it, things like this should be a good reason for revolution. They just got away with screwing all of us over.

Well I would propose at least two changes.
1/ The ONLY valid laws are those written (entirely) by and passed by the duly elected members of the Congress, as provided for in The Constitution, and signed by the President.
2/ No such law shall be enforceable if it contains any form of clause whereby a member (any member) of the Congress or Administrative branch can be immune to the provisions of that law.
That would just about do me. I’m ok if the Congress does the 17 things they are authorized to do, plus does the few things (such as Article IV section 4) they are told they must do.

Mr. Smith,
The system was set up so that each State in the Union retained sovereignty and could leave the Union at any time. That gave power to the 10th amendment and was a real “check and balance”. The idea of “nullification” came from the State’s ability to leave the Union.
Now there is no check whatsoever on the power of the central government. Supreme Court? Ha! They have enabled an expansion of government power that would have astonished the founders.

I believe the XVII AMENDMENT also contributed, wherein, the Senators from each state were no longer elected/appointed by the state legislators, instead being elected at large by the populace. That was supposed to be the way the states were represented and could exert their power over the Federal government through the Senate. Progressives under the worst President ever saw to the nullification of the power/check and balance of the states. The President was Woodrow Wilson, the hero of Obama and Hillary. He was also a racist and promoted eugenics, which the Nazis perfected.

And Wilson was re-elected in 1916 with a promise not to take the U.S. into WW1. U.S. entered the war in April 1917. Inauguration was in March back then.
League of Nations was big agenda for Wilson. Now it’s the UN for the present POTUS.

Good essay, and it was nice to see that someone here knows who Mises was. 🙂
I would add to the essay the point that besides all the laws, rules, regulations and all the rest you mentioned is the fact that prosecutors often interpret the laws and regulations in “novel” new ways. A well-worn example is that the RICO act is used now in ways the people who wrote and enacted the law never intended.
The central issue is that the State is the great evil force that modern mankind just can’t seem to see for what it is. Rothbard had it in “Anatomy of the State” https://mises.org/library/anatomy-state/html

The most important first-day action of the next President should be to fire all agency heads (i.e., “accept their required letters of resignation”) AND their deputies AND their asssistant deputies, etc., etc.
Second, reduce all Cabinet administrative budgets by 50% with the directive that funds will go chiefly to Congressionally directed activities
Third action should be to notify Congress that they shall reduce their staffs by 50%, by authority of the Prresident to veto any legislation that does not expressly include provisions to reduce Congressional staff expenditures by similar amount.
Real estate values in the DC cesspool will finally return to “normal” and the bureauc-rats will flee the sinking ship.

This is a powerful essay written by Paul Driessen. There is little that could be argued against and would be a weak argument at best.
Serious change is needed. Let us not forget who the players are/were when that change comes about.
No more Mr. Nice Guy. In a sense, brutal change will be required. Brutal in this context being that we don’t want to hear a bunch of liberal crying while the change is implemented. No weasel words or claims of ignorance or misunderstanding.
This is truly an issue of national security.

All one needs to do is significantly reduce the sweetness of the pay and perks of Congress and all administration positions. You want protection as a government official, carry a gun. No more taking your campaign contributions home when you retire. Just a few adjustments are needed.

Of all the candidates, i am sure that Cruz is the one that will do it. I’m really not so sure about Trump.
But he would be better than Hillary or Sanders.

I recall the terrible fear and embarrassment of the American elites that the likes of B-movie actor Ronald Reagan could become president. He may rank next to Lincoln as the country’s best president. He got America believing in itself again after the swoon in self esteem of the Vietnam war years and aftermath and as an encore, his ‘star wars’ plan and brash swagger ended the cold war and demolished the iron curtain. Oh and Iran surrendered American hostages after a decade of failure by the Democrats.
America has been softened by the Kumbayah pied pipers of the left and a slow acquiescence of the right. What is needed is another president that scares and embarrasses the hell out of the American Ivy League/political elite/media/. Don’t fear Trump. He is the only one who would undo the two-big-to-fail mess described above by Paul Driessen. The political sector is one that indeed has a tipping point and another 8 yrs of the same old or worse – the red gentleman from Vermont.
For those who think the present administration couldn’t be worse, read “Not a Shot was Fired” by the Czechoslovak communist Jan Kozak. This has been must reading by the far left:

He succeeded with an actual example of his own country – the citizens were made to clamber for it and vote for it – a thing I see happening in America. You will see that the present administration is already aware of this ‘formula’. I recommend it to those who would push for freedom so they know what they are up against.

The way the West was infiltrated 60-65 years ago ( through using refugees and doesn’t that ring a bell) by the communists should be an eye opener to all of us. The plan ( to be honest) was/is brilliant and we see the results today. These people ( the none elected bureaucrats) don’t look for results for a 4 year term they look generations into the future for THEIR children and their goals and they started generations ago and to me their children are close to running the end game right now.

All you Trump detractors here, please take the time to read this summery of his positions from his website and direct quotes from him and his official surrogates.
(I have posted this once before but it was at the end of a 250+ comment thread. Perhaps it’ll get more traction here…)
I am a Trump supporter. Most of the anti-Trump comments I have read on this site are based on past statements he has made which are or seem to be in conflict with his current positions or just plain ol’ lies or complete fabrications from whole cloth.
Given that conflict, he is labeled as a con man, a liar, a mountebank, a moral cripple, a degenerate, someone who would complete the evisceration of the Constitution undertaken by Obama and his cohorts and, worst of all, Obamas alter ego. Most of those anti-Trump commentators claim they are looking for intellectual and moral purity in their candidate, someone who will restore the constitutional constraints which have been torn asunder by progressives starting with Woodrow Wilson, shrink the size of the Federal government, and realign the power relationships between the Federal and State governments in line with the framers intent. Almost all state that Trump has not put forth any policies, only platitudes garnished with hot air.
No policies? Oh really?
While Trump has said that he does not have an answer for every problem facing the US today (does anyone?), he has taken the following listed policy postions and has also made it clear that in arriving at solutions to our nation’s ills, he will enlist the finest minds he can persuade to help in their identification. His stated positions, listed below, are spot on and warrant his being the Republican nominee and our next president.
Long ago he has called this global warming movement “B. S.” (except he used the whole word:  And YES, THAT’S A DIRECT QUOTE!
Prevent illegal aliens from crossing the border by supporting ICE officers in doing their job, enforcing the laws currently on the Federal books, ending H1B abuses, building a wall and establishing effective controls on future immigration which allow only those who will provide a benefit to the US to enter.
Rescind Obamacare immediately and in its entirety while replacing it with market based systems which reduce overall costs and increase the individual’s ability to select insurance policies which are tailored to their needs based on age, lifestyle and current condition.

Revise the tax code to lower taxes for all catagories of individuals and corporations and incentivise the return of US corporation foreign held assests (dollars and manufacturing jobs) to the US.
Restore strength to all branches of the US Military by eliminating political 
influence in purchasing equipment and services which benefit only the 
politicians pushing those purchases but do not satisfy the stated needs of the military leadership.
Appoint supreme court and lower court nominees based on judicial philosophies which mirror those held by Justice Thomas and Justice Scalia.
Appoint an Attorney General who will enforce the law fairly and, if warranted, prosecute Hillary Clinton.
Evaluate the infrastructural shortcomings facing the nation at the Federal and State levels and focusing efforts and resources to eliminating those shortcomings.
Eliminating all Federal aid to Sanctuary Cities and taking action against those entities which defy the law.
Reviewing all foreign aid with an eye to modification or elimination based soley on its usefulness in promoting the commercial and geo political interests of the US.
Reviewing all global trade agreements and relationships to ensure that all participants are treated fairly. Free trade only works when all participants play by the same rules.
Renegotiate or rescind the deal with Iran. 
Support Israel if attacked.
And wait until he gets his teeth into the leviathan this wonderful essay has laid out.

Obama is certainly a despotic and tyrannical gangster, but Hillary Clinton and Bernie Sanders are cut from the same cloth. The main hope for change seems to be Ted Cruz with Trump as a second choice. Unfortunately the Republicans in general seem hopelessly confused and diffuse and unable to use the powers of Congress to stop the Democrat incumbency.

The constitution requires the President to “take Care that the Laws be faithfully executed”. He has violated the constitution when he refuses to enforce (execute) the laws and should have long since been impeached and removed from office. Why not? Gutless Congress.

Not the first president to do so. Dubya included signing statements with 110 laws describing the parts he would enforce, and the parts he wouldn’t. Clinton did the same with 80 bills that he signed into law. (I don’t know about previous presidents.) Not the way it is supposed to be done per the Constitution. The GOP apparently concurred with what Dubya did. Now that Obama is doing the same to existing laws, he can not be punished without a review of the two previous presidencies. He is no worse at thumbing his nose at Congress.
But, Mr. Perry, I agree with you fully. It should never have been allowed in the first place. It should have resulted in impeachment. But it was not a gutless Congress under Dubya – it was a colluding Congress.

I expect it’s not really on your beat, but this problem is hardly unique to federal agencies, it occurs very frequently at the local level at all, and it’s mostly concentrated in the, often Progressive controlled, City and County planning departments. A timely example shows up today:

In this example, the town of Morro Bay CA quietly decided to outlaw parking Recreational Vehicles on private property. Under US Law this represents an “illegal taking” on the part of government; the community reduced the value of private property through regulation without compensation to the property owners.
Many of these cases can be fought under eminent domain law, but it’s costly and unless the regulation effects a class large enough to justify legal proceedings it ends up going uncontested.
The solution is to change our system. Laws are enacted by legislation, not by proxy “administrations”. This has gone way too far and we must stop it.

Chris I am not in the US either but the USA being what it is ? We in the West all have a horse in this race. By showing support in our own countries for Trump’s standpoints in our own countries , like Britain/Canada/ NZ/ Japan/Israel and other Western thinking nations we will need to strengthen his position, it is critical. Here in Canada we just elected a progressive government and the pain has already started. The first budget only 2 days old has already doubled the deficit with 20 Billion $$ for “green ” ,” infrastructure “. There is new opposition from the progessives to pipelines, natural gas terminals, the oil sands and shut downs of coal plants, they all seem to be following the same path as Oz/Britain and so on. Scary to say the least, so let us stand together.

Stand back and take a hard look at what is happening; democracy is being steadily and quietly (secretly) removed and the powers that democracy should wield on behalf of the electorate are being handed to unelected and unaccountable bodies with their own agenda.
The same is true of the EU where democracy has been ceded (without electoral consent) to unelected and unaccountable eureaucrats in Brussels.
The UN is determined to create an unelected global government – hence the climate change agenda as the route to achieving this.
Where has this transfer of power ended up ? The green blob has insinuated itself into the ‘decision making’ process at all levels and taylors policies to meet its own quasi-marxist-socialist extreme left wing agenda. Within the EU the green blob receives millions of euros annually to fund it developing and ‘advising’ policies to the EU law-makers who then implement that without democratic consent or authority.
As I have said for some 15 years the greatest threat facing the world in the 21st century will be to retain democracy where it is under threat and to recover and restore it where it has already been removed by stealth.
On a very parochial level the UK has lost sovereignty and is now effectively governed by the unelected in the EU (75% of our laws) and the only way to recover that will be to vote to leave the EU – perhaps the first steps towards restoring democracy across Europe by showing the way to others.

No country can survive with a $20 trillion national debt, $100+ trillion in unfunded liabilities, $500 billion/yr trade deficits, the highest corporate tax rate in the world, a fiat currency, $500+ billion/yr annual budget deficits, insane zero-interest rate monetary policies, and almost $2 trillion/yr in rules & reg compliance/bureaucratic network costs….
It’s already past the point of no return and can only be reset through a complete economic collapse.
What emerges on the other side of a collapse is anyone’s guess, but history shows it most likely won’t be pleasant…

I read this site because of its rejection of climate alarmism. If I want politcal alarmism there are many other places to visit. Remember when you attack this post how some accuse anyone who rejects AGW of being in the poctet of big oil etc. One does not have to accept a certain set of political thought to see that the alamist science is faulty and overdone. Many people who do not see the climate sky falling also do not see the country in deep peril due the policies of this President.
