It’s a “jump the shark” moment for Mann.
As if taking a cue from yesterday’s essay The Merchants of Smear in deciding “enough is enough”, Herald Sun Journalist Andrew Bolt has decided to stand up to him for defamation. He did so in a most professional but firm way. I repeat what he writes in:

Normally I do not sue, but this seems to me a special case.
Mann, the climate alarmist who gave the world his dodgy ”hockey stick”, is now suing sceptic Mark Steyn for mocking him and his lawyers have produced deceptive legal documents in his defence.
Mann has published an outright lie that defames me, and should face the same punishment he wishes to mete out on Steyn for mere mockery.
I do not lie and Murdoch does not pay me to do so. Nor has Mann singled out a single “lie” I’m alleged to have committed.
In fact, Mann is so reckless with the facts that his tweet links to an obvious parody Twitter account run by one of my critics, clearly believing that it’s actually mine.
Advice, please?

I note this because repeated defamations under Australia’s law is evidence of malice – and your history of defaming me shows a complete disregard for the facts.
It is appalling that you could be so reckless, so spiteful, so destructive and so ill-informed. I have long doubted the rigor and the conclusions of your work as a climate scientist and often deplored the way you conduct debate, but even I had never before today considered publically calling you a liar.
I demand you delete your tweet and issue a public apology on the same Twitter account within 24 hours. Failure to do so will not only cast doubt on your commitment to truth in debates on global warming, but expose you to legal action.

I’ve lost count how many lawsuits is Mann involved with right now?
I suspect he has had a word with his lawyers. They can’t be optimistic if he gets into new fights every other week.

The fall of Mann might become one of the most amazing events of the 21th century.
Even though we are nowhere near such event, Mann has crossed the line of no return. He could have become a low-profile guy. He didn’t, and now he will face the consequences.
It would be nice if more people (such as yourself, Anthony, Dr. Curry, etc) started sending him similar emails requesting apologies and threatening legal action if they do not come, and did the same with each new attack he attempted

Michael Mann cannot stop himself as he has the same behaviour as a spoilt child. He does not think of the consequences when he lashes out, just like a child hitting another child for daring to say something he does not like. After all Mann has little to be proud of: a pretend Nobel Prize; a dubious hockey stick; and an embarrassing “Hide the Decline”. He hasn’t made any scientific acheivements but as Judith Curry once said he was once one of the “Masters of the Universe”. Now the emptiness of his achievements and the long fall to reality produces the puerile revenge attacks.
No calls from lawyers will ever change him.
I’ve been predicting that Mann will fold like a cheap suit (get it?) under the pressure of Steyn’s countersuit which was a brave and brilliant stroke.
This latest personal humiliation for MAnn will only increase the pressure on him to withdraw, including from I imagine, some of his fellow climateers who must see great damage to The Cause flowing from all things Mannian….and his lawyers given what’s turned out to be the fraudulent nature of those legal documents. I’m sure his lawyers by now are amazed and repelled by what they’re seeing from their prize client…
OTOH, they’re lawyers racking up billable hours. Must be quite the internal struggle for them…the dueling impulses between greed and fear of humiliation in the courtroom.. (Though it will never get that far).

Maybe this is just the beginning.
I would not accept those “apologies”, they are not adequate and don’t refute the actual initial tweets.
I can just imagine how exasperated his lawyers are – I’m sure they have some very good advice for him – “Next time you think you got something to say – DON’T!!!!”

Can you please explain the distinction between “promoting a falsehood” about someone and a “lie”? How is one not necessarily the same as the other?
My bet is that when the emails Dr. Mann has fought so hard to hide are finally leaked out – and they will be= what we see revealed will make climategate look tame. Mann is a real piece of work.
It’s a shame that Andrew Bolt has been slimed but his riposte seems perfect to me. It will be interesting to see if Mark Steyn can bring to the court’s attention in his case with Mann, this evidence of malicious falsehoods. Even if not, the Net will not forget. The best part is that these are self-inflicted wounds; and cannot be healed.

Anybody who thinks Mann is scared of lawsuits is seriously miscalculating.
I am of the opinion that Mann is probably suffering from Narcissistic Personality Disorder. If I am correct, Mann is likely to enjoy suing people and the thrill of fighting people in court because the court system provides him a forum to attack people that gives him great psychic satisfaction. Prior to trial, there is a phase where the parties make initial representations regarding the dispute. The parties are not immediately called to task for any misrepresentations. They are given wide latitude in the things they can claim, and unless one has been adjudged a vexatious litigant by the courts, the court will take each claim seriously.
Since the trial – the put up of shut up time – is often months or even a year away, a narcissist can get months of satisfaction out of making the allegations. The more delusional ones will enjoy the actual trial phase as well, convinced of the rightness of their cause, even as everyone around them recognizes that they are on a doomed course. Often this latter group will then resolve the conflict between their expectation of victory and their loss by deciding that the judge is part of the conspiracy against them and the cycle begins anew.
The case of Mann’s suit against Ball fits the profile. He initiated the suit to great publicity, but is dragging his feet on discovery. This is in my mind a huge tell that Mann is not seeking to be made whole by quickly resolve the issue, but is instead getting what he wants from the operation of the process itself.
Stop it, stop it, stop it. At this rate I’m going to feel sorry for Penn State alums and parents.
Sometimes it seems like Mann spends half his day suing people for defaming him, and then the other half of his day defaming others on twitter.

Let me speculate that Mann’s lawyers are increasingly unhappy about his chances, and increasingly nervous about the quality of any “facts” that he asserts. This means extra work tor them to check everything twice before relying on it in their submissions to the court; and extra work means extra cost. Maybe Mann has backers with deep pockets, but nobody likes being played for a fool. I imagine that Mann’s public “apology” is nothing compared to the groveling that’s going on behind the scenes. All this can only help Steyn. Good!

Steyn won’t be settling for non-disclosure. Every claim that Mann has made will be put to truth. One way or the other. No non-disclosure, win or lose. Mann is getting hammered in public by the likes of McIntyre’s analysis of claimed exoneration and it translates to the court. The best Mann can hope for – he doesn’t recognize it – is that he drops his suit and Steyn concludes that Mann is already fully exposed by his tacit admission of what has been documented on these and similar pages. But that would be letting Mann off the hook for his own offenses that he is likely to continue.

I was thinking of giving Mann the benefit of the doubt given that USA an UK are separated by the same language; however in this case it is not so:

I have a theory! Albeit, I am NOT a Twitter user, so I will require some help with data aquisition in proving my theory out.
If we were to plot all of his twitter comments on a 24 hr timeline (horizontal axis), with the verticle axis relating to civil and uncivil tweets (civil low on the graph and uncivil high on the graph), I believe we could determine corallation via causation surrounding happy hour. I predict a hockey stick of uncivil tweets would appear after 5 o’clock.
Raw data would suffice. No homogenization, smoothing, adjustment, or extrapolation required.
Ultimately, we may find that “Happy Hour” could play a significant role in CAGW in the end 😉
We all want Mr Michael Mann to disappear but think of the utter enjoyment we have at his expense , when he is gone you will all be twiddling your thumbs not knowing what to do.

In a case of law, it isn’t just the facts that matter. There are a lot of things pertaining to legal process that will cause you to lose your case, even if you are right on the facts.
Is Mike Mann related to John C. Beale? How would you know with all the pseudonyms at EPA.
It appears Mann is having a public nervous breakdown. Not only will he have to be deposed, but every public comment he made online will be entered into the civil suit. Besides his reckless comments, his biggest enemy will be the WayBackMachine internet archive.
I think this is what Bolt was looking for:
What’s needed is a US based court to order Mann to release all his code/data within 30 days (which must be a reasonable enough period considering how long he’s had to do it for the Canadian court), or else face the equivalent of the UK’s ‘Contempt of Court’ charge, which is taken very seriously and has jailed a few UK politicians. The order should similarly be placed on any who were his co-publishers for the hockey stick, such that there is extra pressure on them to comply (his co-authors won;t want to suffer legal penalties for his malfeasance). Perhaps a similar court order should be made here in the UK, as the hockey stick underpinned the IPCC report, which in turn underpinned so much environmentally based legislation and tax.

This does not necessarily….or even likely follow. Mann may be a narcissist, but he’s also a coward. He knows he’s got plenty to hide and is scared out of his mind that he’s be revealed as the fraud he is…which is why he’s gone to such Herculean efforts to keep his emails protected,and also why he’s been suing people left and right who dare impugn his reputation. Of course, this is not rational on his part, as he only makes it more likely that he’ll be painfully exposed, which again is his great fear.
My armchair diagnosis is he’s impulsive and full of defensive rage due to deep seated feelings of inferiority. In short, he’s a mess, internally pulled in several directions at once. I’d feel sorry for the guy if he’d ever show an ounce of decency.

The implication would be that Mr Bolt was reporting information from a third party source that is false, but could not reasonably have known so.
If you want somebody to change and fix something, you have to appreciate it when they make an effort. This is the first instance I have ever heard of Mann apologizing for anything.
When people have a long history of error or crime, the first changes are small. It is important to appreciate these.
I salute Michael Mann for his correcting tweets.

He singlehandedly smote a Canadian statute on hate crime in a case where he was hauled before a human rights tribunal for an article in McLeans Magazine. I suspect there isn’t a lawyer in this or any country that knows as much about freedom of speech as Steyn. Don’t let his being a “bad boy” deter you from contributing. Michael should “Mann-up” and apologize
A wise retraction and rephrasing of an overly strong statement on Mann’s part. It is usually difficult to *prove* someone is paid to lie. Such things are generally done as a tacit understanding rather than spelled out in a contract or on a paycheque.
I believe that in Michael Mann’s threatened legal action against the Minnesotans 4 Global Warming, for the hilarious video parody they made of him, his claim to damages was that they couldn’t use his likeness because it was protected by copyright.
Does that mean that all overweight, balding men who sport Van Dykes are potential defendants in a Michael Mann lawsuit?
Mann was embarrassed for having made reference to the wrong site, that’s all.

I’m thinking you probably mean 1st Amendment. The 2nd Amendment has plenty of support from other groups.
BTW: I think Steyn’s decision to represent himself may be more clever than people realize. It’s oftentimes said that in the legal system, whether you’re guilty or not, you’re still going to be punished. At least in civil cases that saying is true. The plaintiff usually has the advantage insomuch as their lawyer is usually working on contingency – so it costs the plaintiff nothing to pursue the case until they win. The defendant however, win or lose, is still punished with a large legal expense. That may be Michael Mann’s strategy; at little jeopardy to himself he can silence critics merely through the threat of ruining them financially. Steyn’s decision to represent himself may actually be a very clever statement to Mann: your case is not sound; and with my counter suit, it could cost you more dearly than it’ll cost me since I am representing myself.
If only he spent this much time on actual science.

Please. Michael Mann isn’t suddenly developing character. The apology was driven by fear of being sued…the very last thing he wants right now given his other troubles. I also wouldn’t be a bit surprised if he was pressure to do so by his lawyers.

My understanding, Richard, is that at this stage the only way to help Steyn is to buy stuff. Others have suggested buying a gift voucher and then never using it – I saw one ingenious chap say he’d bough a $200 gift voucher which he would never spend but keep as a momento of his having helped.
The definition required to win a defamation case is a false statement made to two or more people that would lower your reputation in the eyes of a reasonable person (UK) or caused harm (US) basically. There is no defence of opinion for a direct unconfirmed statement such as ‘you are a liar, you are paid to lie, and Rupert Murdoch pays you to do so. This way he has libelled both of you (as permanent format) and you both have a pretty watertight case for libel but the costs involved are painful if you go ahead. I’d suggest a joint suit with Murdoch, who both has the resources and the will to act, I may not be a scientist in these areas but do have a law degree.
I say, Mark Steyn and Andrew Bolt, go for the jugular (figuratively, of course) on the Womann-named-Sue. She certainly has it coming. But be careful, even her blood probably stinks.

Steyn writes over on his website that he didn’t want a legal defense fund as he anticipated going on the offensive :).
Mann’s behavior seems to be representative of other warmists as well – they say things & act as if they are above the law – because they are so convinced that they are right they absolutely can’t conceive that anyone else could be right & obviously deeply believe they have to save the earth from humanity, at any cost.
Look at the “climate ugliness” category on WUWT & look at how many of the key figures on the warmist side are involved in similar behavior. It’s stunning & sad when you review.
This is not about science. This is a crusade. This is blind faith. Mann’s latest outburst clearly illustrates this.
For skeptics, it’s a mindset that is tough to fight with science, which is generally how skeptics like to operate.
Anyone with a background in psychology care to expand / analyze this behavior ?
this pattern of behavior makes me wonder if it would be worthwhile doing a statistical analysis evaluation of mann’s dissertation. Seems like it might have been heavily associated with using the montecarlo technique. Judging by his personality and recent record, it might be very worthwhile to go through it and determine if it is totally fraudulent or flat out in gross error. If right, this would seal mann’s fate both in court and academia.

Their arses are covered by every government department, every once-venerable society and every aspect of the mainstream media. They will not be called out by these arms of the state.

I don’t think that either Bolt or Mann can claim to not be public figures. It is difficult to see how any judge will take any of this seriously. Perhaps he will fine everyone involved for wasting the courts time?
In the end its that famous email “Mike’s trick and hide the decline” that is really going to bring down the edifice of AGW! So whoever released them will be the hero of the day.
Obviously Mann must be trying to set the stage for an insanity plea. Why else would anyone under scrutiny tweet such a thing.
Me thinks that Michael ‘rain gauge’ Mann has a nasty habit of digging holes for himself. His lawyers must be fuming.
Why doesn’t he sue Andrew Bolt for accusing Mann of publishing a defamatory an “outright lie”?
How could that possibly be an apology? It repeats the baseless charge. It’s the equivalent of saying “I apologize for calling that liar a liar.”
“So? I’m saving the planet. Sheesh, priorities!“
Mann is obviously a person of honesty and rigor who checks his facts before making anything public.

It’s just a shame that supreme lack of professionalism isn’t weeded out of the scientific community; Mann deserves no respect as a scientist.

I have long admired Andrew Bolt for his up-front stance on the AGW scam – which goes way back to the Al Gore inconvenient truth days, and collected many of Andrew’s articles on the subject. He has been pointing out the nonsense in the Alarmist’s position since day one and I hope he will continue to do so until the beast is slain. I doubt that Andrew’s job is in more danger than Mann’s.
It’s kind of a shame that Mann has sort-of apologised. What a dingo! I’d have enjoyed watching Rupert Murdoch going after him.

I would not have requested an apology, and I sure as hell wouldn’t accept one even if he were gracious enough to admit being wrong and issue one.

Nice! I was pretty skeptical about this whole thing, but it seems that Steyn is fighting and there has been great commentary and support from skeptical bloggers and digging by Climate Audit, etc. And Mann being Mann he has opened himself up to real scrutiny of his dubious legal claims. And since Steyn counter sued, Mann can’t just jerk Steyn around for a few years and then drop it. Game changer potentially.
Don’t forget Mann is a hero to those with the pro-AGW fervor. By carrying on as he has, he is getting richly rewarded with research grants, speaking fees, pro-bono legal, Knighthoods to come etc.
The other side has all the resources and power over who gets those resources. At least $20 billion per year that is (not including the $330 billion of other climate change funding).
I feel worst for my profs, The Hoslers, Blackadars, Panofsky’s Myers’s, Cahirs, Duttons, Anthes, Fritsch’s and a host of others that built PSU into the worlds number 1 meteorology school in the 60s70s. If this turns out the way I think it will, it will be ashame.

Unfortunately, Mann is daring the world to throw him into prison – he likens himself (privately, I am sure) to Nelson Mandela with proxy data and “princomp”, persecuted over principles, … and principals (the quants here will know what I mean!).
I can’t bear the thought of David Suzuki doing stories about Mike Mann, jailed climate hero. Think of the “free Michael” protests around the world. No, far better is confiscation of his house and all his savings, and the future garnishee of his very generous income… Harder for the Reds to get all worked up about some wealthy blow-hard getting his dough pulled back!

Isn’t repeating a defamation is still defamation. Isn’t this is the case against Steyn? Not what he wrote, but what he repeated.
