The Heartland Institute today released more evidence that Pacific Institute President Peter Gleick was the likely author of a fake “climate strategy memo” that Gleick originally claimed came from a “Heartland insider,” and later said he received “in the mail” from an anonymous source.
Heartland released a computer forensics report, conducted by Protek International, which states: “We conclude that the Memo did not originate on the Heartland System. It was not created on the Heartland System and was never present there prior to its February 14 posting online.”
The new report contradicts disgraced climate scientist Gleick’s claim to have received the memo from someone affiliated with The Heartland Institute and adds to a growing body of evidence pointing to Gleick’s guilt.
A month ago, Juola & Associates, the premier provider of expert analysis and testimony in the field of text and authorship, said “it is more likely than not that Gleick is in fact the author/compiler of the document entitled ‘Confidential Memo: 2012 Heartland Climate Strategy,’ and further that the document does not represent a genuine strategy memo from the Heartland Institute.”
Heartland Institute President Joseph Bast said: “The Protek International forensic report is one more piece of evidence that Peter Gleick created the fake document with the intent of defaming us and the scientists we work with. He and his co-conspirators are so desperate to discredit anyone who disagrees with their alarmist views on man-made global warming that they are willing to lie, steal, and even defraud their own friends and allies in the media.”
Bast added: “We once again call on Gleick to make a full confession, and on the Pacific Institute and its allies to stop defending Gleick and his unethical and illegal conduct.”
Background:
On February 20, Gleick, a prominent climate scientist, confessed to being the anonymous party who obtained confidential corporate documents from The Heartland Institute and circulated them along with a document titled “Confidential Memo: 2012 Heartland Climate Strategy.” While confessing to using fraud to obtain the stolen documents, he claimed to have received the “climate strategy” memo anonymously in the mail.
Since “Fakegate” occurred, ThinkProgress, Greenpeace, 350.org, and other radical environmental groups have been using the stolen and fake documents to attack Heartland’s corporate donors and the scientists who work with it.
The Protek investigation was conducted by Protek co-founder Daniel Bellich, a 27-year veteran of the FBI and former supervisor of the Chicago Division’s Special Operations Group, and Keith G. Chval, former chief of the High Tech Crimes Bureau of the Illinois Attorney General’s Office and president of the Chicago Chapter of The American Society of Digital Forensics and Electronic Discovery. Both men signed the report on April 20, certifying they would swear to its findings in a court of law.

I was wondering a while ago when someone would get around to using styleometry to check on the authorship of the fake memo, it’s been interesting to follow the results. A former employer of mine did similar work in their information security research, was always fascinating to talk to those guys. Interesting algorithms.

He may have lied to avoid being arrested. But he surely lied to get the accusations talked about and he did just that. The Heartland defense gets whispers compared to the lie-based screams.
I really don’t understand why this is news. From the timeline, from the content of the faked memo, from everything about this case, it’s obvious to anyone with more than half a brain that Glieck was the author. Why don’t Heartland just take the fool to court and stop messing around?
On the other hand, this does all tie in quite nicely with the article on Groupthink posted yesterday – particularly the idea that members of such groups eventually believe themselves to be so moral that they can perform immoral (or illegal) acts and it’s OK because they are acting for The Greater Good.
Yawn. Get him arrested or get over it.

The worst crime a scientist can commit is to lie. Unfortunately “climate scientists” have more than their fair share of liars, all lying through their teeth and fabricating evidence to keep their gravy train running.

As a lurker on this site and looking at many of the posts above seem to agree with me, but unless something is going to be done about it, stop whining move on and talk about the science. The constant vilification of Gleick is impotent if no action if forthcoming, and to continue, as one user above wrote, to carp on about it has a certain air of desperation about it. Heartland should sue or STFU about it, because frankly the whining is getting tedious. Gleick has dubious scruples, if all this is going to amount to is incessant name calling then you just fall into the trap of distracting from the core issues at hand. Sorry to be so negative, I respect this site and a number of its contributors but this is just pointless unless there is going to be a bite with it.

I have a lot of sympathy for Heartland as victims of this fraud, but frankly I’m losing patience – they need to stop protesting and actually sue the guy, otherwise it’s pretty much an empty gesture, and largely a waste of time & energy.
On a side note, sometime ago, I posted a comment on Heartland’s blog (on their story about them asking Oxford not to encourage Gleick to speak at the Amnesty event) – and this comment has never appeared.
My comment pointed out that
1. Gleick was due to speak at a water security conference at Oxford the week before the Amnesty event.
2. The water conference appeared to be an official Oxford University function (unlike the Amnesty event which I don’t think was)
3. That in the conference agenda materials, it stated that Gleick was President of the Pacific Institute, and seemed to suggest he was appearing in that capacity (suggesting his suspension/leave-of-absence is either over, or never took effect in the first place)

On earlier thread on Gleick, some legal expert said that Heartland is getting the best legal advice available, by specialists in this sort of thing, and that they know what they’re doing in the tactics they’ve followed (by not suing yet and not seeking a criminal indictment).
Agree with Cuthbert. If this document is going to be ammunition for a court case, shouldn’t it be “kept dry” until the actual engagement? If it’s not going to be used, it’s pointless.
The establishment has no conscience and still holds all the power. Moral appeals have zero effect; a court case that requires them to spend lots of money will have some effect. Their behavior will only change when the cost/benefit ratio inverses.

Its better to get the criminal case going before the civil case. Its possible that HI is having trouble getting the US Attorney to act on the criminal case. My guess is that Heartland’s legal team is looking at civil action first. Squeeze Gleick for as much money as they can get. Then go for the criminal prosecution. If they went in reverse order, Gleick’s legal bills for his criminal defense attorneys would decrease the amount available for compensatory damages.
Second, if there’s an immediate criminal trial, it’s likely that Barry would pardon Gleick. For that reason, it’d be better to hold off on the criminal charges until after Romney wins the election.

As I’m not a lawyer, perhaps that is why I expected action a lot quicker than this. I am very disappointed Heartland do not seem to have taken any of the non-legal action which was open. E.g. I have heard nothing about any complaint to the UK press complaints commission and BBC where they were almost guaranteed to have won. Perhaps this comes after a legal case. I don’t know, but all this inaction suggests they don’t intend to progress any further than publicity, which is tantamount to saying Gleick was right and we were wrong.
I know the Heartland institute are a commercial business. The longer I wait, the more I wonder what is going on. Have they been bought out in some way, or worse, are just using us to get publicity for themselves?
We are sceptics … we are rightly just as sceptical of the motives of sceptics … until we see the colour of the legal brief. Let us hope for Heartland’s sake we see action soon.

What world do you live in? Our Environmental Protection Agency admits they would ‘crucify’ an oil company for next to nothing, while our Department of Justice is less interested in Gleick than they are in securing our borders or preventing voter fraud. Along with several others who post here, I E-mailed the DOJ asking if/when they would be opening an investigation. We received the computer generated “Thank you for your inquiry” reply, but have heard nothing since. It’s better for President Obama that this be pursued in civil court anyway. That will spare him the embarrassment of pardoning Gleick as he leaves office this coming January.
Get over it my ass. It’s time for the punishment to fit the crime. Climate fraudsters and criminals like Gleick and Mann need to be exposed and punished. The Heartland Institute should hire the best lawyer available, expose Peter Gleick’s lies, and trumpet them loudly and repeatedly in the most public forum possible. The Virginia Supreme Court should force the release of Mann’s e-mails for the world to see and let the chips fall where they may. In both this cases, the largest monetary judgement possible should be won, and liens should be placed on everything they own.
I suspect Heartland don’t want things to move too quickly, especially if they intend to extract maximum value from any legal process. This is, after all, an election year in the US.
The genuine documents also appeared to show what I had always assumed: That they are not a large organization with deep pockets and resources to spare.
Has Gleick been,at the very least, suspended from his job? If not, why not? Anyone in my company doing something like this would have been out the door in a flash.
Back in the 90s, a liberal old couple illegally recorded a conversation between Gingrich and Boehner who were “conspiring” to uphold the law. The press tried to make hay of it, until the legal authorities got involved and started threatening prosecutions.
The law breakers learned. So when they broke the law this time, they made sure they forged some documents to keep the heat on the story, instead of the crime. The only problem is they learned a single lesson. Not all the lessons.
They forgot Rathergate.
In any civil litigation, the first claim Glieck’s lawyer will make is that the insider strategy document really came to Glieck from a Heartland insider.
Heartland (and their legal team) quite naturally want to preclude that claim and the Protek investigation provides for:
1) Affirmatively refuting the remote possibility that some disgruntled Heartland insider really did write it. Consider the consequences of Hertland top management and lawyers being blindsided during “discovery” of some evidence that a Heartland insider forged the memo. This step eliminates that possibility.
2) Affirmatively demonstrating the memo is a forgery, not merely by presumption and inference but by definition, in that it did not come from anyone inside Heartland, ergo it was forged by an outsider.
3) Preempting Glieck’s claim to have recieved the memo from a Heartland insider, and exposing Glieck to discovery on the provenance of the forgery he has admitted to possessing and promulgating.
Litigation is like chess: castle your king early on, know the outcomes of any move, be prepared to counter, be prepared for a long game.
What is disconcerting to me at this stage is there have been no reports of Gleick’s computers (at home or office) being seized. But Glieck wouldn’t likely publicize that, the FBI would tend toward “no comment”, and Heartland and their attorneys may be playing their cards close to their chest.

It’s not a question of not wanting to read the story.
I want to read the story, regardless of what it says.
However what it does say affects my opinion, and I (and others) are entitled to say so. Lack of action on Heartland’s part, affects my opinion of them.
Read Only Memory never changes!
Heartland officers and lawyers have so far carefully timed and measured each legal footstep in their strategic plan for bringing Peter Gleick to justice by due process of law.
Gleick is already damaged goods in the open intellectual marketplace dominated by independent thinkers. That is the case no matter what intellectual support he receives from his fellow activists who represent the pseudo-consensus which is called the IPCC’s CAGW.
Heartland will maximize exposure of Gleick’s professional dishonesty and fraudulent acts shown in Fakegate.
I do not agree with many commenters on this post who think there is a delay by Heartland. What I see is a process evolving to meet changing circumstances and contingencies. Looks reasonable.

Courts don’t usually go for the “why it’s obvious” type arguments. You have to present your evidence with all the ‘i’s dotted and all the ‘t’s crossed. That takes time to do properly.
My middle girl graduated from high school last May, I still don’t have a final court order, officially lowering my child support payments.
Read all the words! The previous one was by Juola. It concerned stylistics, etc. This is an examination of the Heartland’s systems for traces of the memo prior to its distribution by Gleick.

You may have hit it. There have been, after all some truly remarkable non-prosecutions under Holder, and the Administration has a leftist in charge everywhere Obama could quasi-legally stuff one. Everywhere else, a “czar”. HI may be waiting/hoping for a less hostile political/legal environment. And their sponsors may have gotten squoze, etc.
So perhaps it’s prudent to try and put down a few solid public “markers” before charging in where many angels have met untimely ends.
