What really goes on at COP16 in Cancun

I’m really disappointed that I didn’t get the “fossil of the day” award. Watch the presentation at COP16 and get some popcorn.

I wonder if the producers of Jurrasic Park gave permission to licensed use of the logo, of if they are just scofflaws?

Well I’m old enough to remember the drug crazed flower children of the 1960s; and this bunch of flakes aren’t any different.
This kind of “documentary” needs to be exposed to the widest possible audiences to show what hope and change has led us to.
I thought it was hilarious, that these infants are still trying to blame President George W. Bush for our current ills. Hey ! Earth to Cancun; we’ve had two years of the new touchy feely “hope and change” with everything in Washington DC in the hands of the Socialist/Marxist Democrats, and their boy wonder President (but he IS The President); so how come they haven’t fixed all the mess that GWB created; there has been nothing to stop them; with the Republican opposition hamstrung by woosy RINOS, who haven’t succeeded in attaching any sort of amendments to anything the Obama administration wanted to rubber stamp.
So these children in Cancun; are barking up the wrong tree. Little do they know that it is THEY who are going to be handed the BILL for all of their childishness. Well come to think of it; those 60s flower children are now the ones in control of the whole operation; aren’t they ?
Say Canada; save a spot for me; somewhere in British Columbia; does Commonwealth membership count for anything these days in Canada ? If global warmig sets in as promised, I could become a semi retired farmer in BC; close enough to the salmon and steelhead fishing; not to mention those huge lake trout and char.

To his credit the artist involved with writing 350 in the outback did reply back. Although given that they used earth movers to put the 350 down, it is part of a larger bush regeneration project as the immediate area is ‘degraded’ (I really don’t like that word as a label after Indonesia) – so although I do not agree with the message, this should result in a larger good to the local environment. Just wished they had found a less environmentally disruptive way to put their message across.

A couple years ago my daughter attending grade 10 told me she had chosen to speak on the state of the Polar bears.She had done the research,and thought it wrong they were being put on the endangered list,even though their numbers had risen for her entire life time. I warned her of how her peers would respond for questioning this decision.
She got as far as: “Polar Bears have been placed on the endangered list even though their numbers are increasing”
She was booed so load that she could not continue,and the teacher allowed it,but the hipocrite gave her a passing grade,which I am proud to say she did not need or accept!

The Fossil of the Day is significantly altered and it’s not for profit as far as I know.
In your case you reproduced the Jurrasic Park logo without alteration and I’m not sure if this website could be considered a for-profit enterprise.
People who live in glass houses shouldn’t throw stones.
REPLY: And people who comment should look up “fair use” in media before hurling stones. Citing a logo in a story with clear ownership listed certainly is fair use. But, modifying a highly recognizable logo and making it the centerpiece of your organization and website and then broadcasting that modified logo worldwide on video? Not so fair use. The profit (or lack thereof) issue is immaterial. – Anthony

Go Canada Go – From frosty Faraway, Alberta (yes, it’s a real place).
These people are truly clueless. Here are some numbers:
The developed area of the Alberta tar sands is 530 square kilometres.
Cape Canaveral (Kennedy) is 570 square kilometres.
The endangered boreal forest in Alberta is 381,000 square kilometres.
The James Bay Hydro project in Quebec permanently flooded 13,000 square kilometres – a GREEN project – well maybe more blue than green.
Canada contributes 2% of the world’s GHG’s, shutting down the oil sands completely would reduce the world GHG’s by 0.1% and virtually bankrupt the country as jobs all across Canada are generated by activities in the petrochemical industries.

Chilled Vancouver commuters faced their second day of winter hell today, as an additional ¼ centimeter of the peculiar white stuff fell, bringing the lower mainland to its knees and causing millions of dollars worth of damage to the marijuana crops. Scientists suspect that the substance is some form of frozen water particles and experts from Saskatchewan are being flown in. With temperatures dipping to the almost but not quite near zero mark, Vancouverites were warned to double insulate their lattes before venturing out.
Vancouver police recommended that people stay inside except for emergencies, such as running out of espresso or biscotti to see them through Vancouver ‘s most terrible storm to date. The local Canadian Tire reported that they had completely sold out of fur-lined sandals.
Drivers were cautioned to put their convertible tops up, and several have been shocked to learn that their SUV’s actually have four wheel drive, although most have no idea how to use it.
Weary commuters faced soggy sushi, and the threat of frozen breast implants. Although Dr. John Blatherwick, of the Coastal Health Authority reassured everyone that most breast implants were perfectly safe to 25 below, down-filled bras are flying off the shelves at Mountain Equipment Co-op.
“The government has to do something,” snarled an angry Trevor Warburton. “I didn’t pay $850,000 for my one bedroom condo so I could sit around and be treated like someone from Toronto ..”

A hopeful sign? I just watched some Canadian TV news networks where these stunts were big stories for Copenhagen, and I saw nothing about this! And they must be getting bombarded with tweets etc. from this crowd.
Maybe tomorrow they’ll give Canada the Super-Duper-Extra-Bad-Fossil Award while dressed in polar bear suits to see if they can generate some more interest?

And they are being used in the worst possible way, a little like the string ensembles that were forced to play for the entertainment of their guards in the death camps, except these kids are unaware of the evil of those like Maurice Strong who are using them for their own ends.

I’m quite well aware of “fair use” policy. You evidently aren’t aware of transformative use. The Fossil of the Day folks are as innocent of trademark violation as you are due to material alteration of the logo and transformative use. And I’m afraid you really stuck your foot in your mouth about commercial use being irrelevant – it’s the first thing mentioned in the statute section on exceptions:

§ 107. Limitations on exclusive rights: Fair use
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include —
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

The Fossil of the Day website has no paid advertising on it, they aren’t selling things for a profit (like Weather Widget software and electronic gimcracks), so they’re in the clear for commercial nature (1) where in your case it’s not so clear.
In both cases the use is transformative as neither of you are advertising movies or making any use that could somehow be construed to harm (4) the studio or whoever owns the Jurrasic Park logo so it appears you’re both safe on that count.
The Fossil of the Day is clearly and substantially altered whereas you displayed an exact copy. Thus you’d fail the test for (3) and it would be a judgement call for whether Fossil of the Day used enough of the original mark to be infringing.
People who live in glass houses (and don’t know the law) shouldn’t throw stones.
REPLY: Heh, you haven’t a clue what you are talking about. And if you had been aware of “fair use” you would have mentioned it the first time. Sorry. I’m doing reporting. As you point out, “news reporting” is defined as fair use, something I’ve known for a long time. Using the logo in the article is indeed fair use, just as a newspaper might use the logo in a news story. Does the fact that the newspaper sells advertising for “widgets” negate the fair use for the purpose of a story? No. Would a newspaper or news website that used the logo to report on the movie, or something related to the movie be violating copyright even though other competing movies are advertised on the newspaper movie page? No. Neither is WUWT in using it in a news report with. Modifying a logo and making it your organization’s logo may be transformative, but as this thread demonstrates, everyone instantly recognizes it as the Jurassic Park logo. Perhaps not transformative enough?
Another example: Would a news story about fake Rolex watches violate the Rolex logo copyright by showing a comparison photo of two Rolex watches side by side, one real, one fake in the news story? Obviously not. My showing two Jurassic Park logos in a news story, one real, one fake (or transformative if you wish), is no different. Thus, your argument fails.
And…how do you know they aren’t selling “fossil of the day” t-shirts and knick knacks there at COP16? I see lots of things they have with that Jurassic Park turned fossil of the day logo printed on it all over the web. I guess we’ll just have to find out.
My question about whether they obtained clearance was an offhand remark of curiosity. But, since you’ve been so instrumental in elevating the issue beyond just a simple question of curiosity, I’m going to send a letter off to the licensing and merchandising department of Universal Studios to find out how they see the issue. If they have no problem with it, obviously I won’t either. – Anthony

Things might get even more interesting as the BBC forecast at 1.30 pm today suggested that the temperature in Scotland early Friday morning might be as low as -25 to -30 C, possibly breaking the lowest ever recorded of -27.2 C (last equalled in 1982). Not sure if it will get quite that cold, the forecasts last winter also suggested a new minimum record but it never happened in the end.

Sunny Fife with a foot of snow in my garden. Just dug my thermometer out of the snow but it only shows -1 C (mind you it’s not a good one and right next to the window so it’s definitely colder than that). Kids off school possibly for the fourth day in a row tomorrow but they’re thankfully not bored of the snow! Bit bemused by it all, really, as a German I don’t think it’s that bad but the council clearly can’t cope. My parents live in Germany, on a rural road with just one neighbour and even that’s cleared daily but I reckon German councils simply have more snow ploughs/blowers and staff (as well as more money in the budget, most likely,) to cope with the winter.

I was thinking that was a trademark not a copyright. I’ll defer to your superior knowledge on trademarks. My expertise is in patents but I was involved in a number of minor online copyright disputes where the cease and desist resulted in immediate ceasing and desisting. One that was more interesting was in the production of a film “Expelled: No Intelligence Allowed”. One infringement claim was in regard to a molecular animation “Inner Life of the Cell” which was created by an independent who was commissioned by Harvard’s Life Sciences department. Harvard owned it and had made it public on youtube and elsewhere. The complainant was the independent who produced it for Harvard. The animation used in the film wasn’t the original but was done by an outfit hired by the film producers but they were clearly told to make something very similar. It was clearly derivative. Harvard didn’t want the bad press and made no complaint. The other item was about a 10-second audio clip of John Lennon’s “Imagine” and Yoko Ono sued. This was a few years ago and I spent a fair amount of time educating myself on fair use doctrine just for my own satisfaction and so I could talk about it from an informed position. The former (Inner Life) dispute never went anywhere because the copyright owner didn’t pursue it. Yoko Ono eventually lost the dispute in court. She had an ideological objection to the context surrounding the use (political commentary) and thought she could punish the producers through the clout of her legal resources. The producers had in fact anticipated the need for legal defense and budgeted for it from the outset and rather than back down just went ahead and used the legal defense budget they’d allocated.

Fair use is whatever a judge and jury decides is fair use. There is no “right” to fair use there is only precedent that may serve as an affirmative defense if you’ve got the resources and desire to defend yourself. The blog I used to manage got regular cease and desist notices from publishers, especially scientific journals, for quoting too much of peer reviewed articles that were behind paywalls. In every case we rolled over and removed it but we continued with the practice and left it up to the publishers to continue deciding when we’d gone too far.
And by the way, I didn’t recognize the Jurrasic Park logo and wouldn’t have known the kiddies copied the general shape and layout of it without you pointing it out. Jurassic Park is pulp trash that doesn’t draw my attention.
I’ll bet dollars against donuts that the studio won’t put the kiddies on notice because of its potential to result in a David vs. Goliath public relations nightmare. The kids I’m sure would would welcome the publicity opportunity and play it to the hilt while immediately complying with the cease and desist notice. That’s what I’d do if I were them. Who’d win in a legal contest is anyone’s guess but if push came to shove I’d bet on the Hollywood studio who owns the trademark just because they can afford better lawyers.
Be that as it may it was still churlish of you to point it out. Your character is diminished by it.

And, I’m not “picking” on anyone. I asked a valid question, and at your angry prodding, asking more now. I doubt the “fossil” crew will even respond to my questions anyway. And does asking them about logo licensing constitute “picking on” somebody? Good grief you have a strange view.
They’ll probably just remove the logo at some point in the future when nobody is paying attention rather than admit they pinched it. Of course if the situation was reversed, and say I used the Jurassic Park logo here for some purpose, you and a bunch of other people would be all over me. – Anthony

I always tell my own kids: “These days EVERYTHING is on record, so be very careful so that your actions/words today don’t come back to haunt you tomorrow.”
Twenty years from now when someone in the video would like to run for office, or for a high level position in a large corporation college, etc., he/she is going to look at that video and think: “OMG! How could I ever been so stupid!”
Then again, temptation is a powerful thing – Free trip to Cancun anyone?

Considering the errr…. “caliber” of these people, ya gotta admire how far they got with the whole agw fraud. But they also had Al Gore and numerous climate “scientists” in their corner. Now that those players are publicly known fraud artists, there just remains these artsy fartsy scientological enviro-nutbar activists to deal with. They do their own disservice to their own credibility every time they open their mouths or put on a silly productions like this. I hope they keep on keeping on.

I would wager you are one of a a very few people to accuse Michael Crichton of authoring “pulp trash”! While it is scientifically questionable, it’s still a pretty interesting novel and the movie was a watershed moment in film history.
Of course since then scientists have nearly mapped a complete mammoth genome. While certainly far, far younger and more plausable to do than dinosaur DNA, whose to say what is ultimately impossible?

That, too, is correct, but you have not seen anything yet if you have not compared the see of red that comprises Canadian athletes and spectators at international sports events to such manifestations under Stalin and Mao. It’s a legacy left by P.E. Trudeau. He often and publicly expressed his strong communist leanings and had us bear witness to his wishes by instilling in us our passion for the colour red at such events.
For those reasons, in spite of all of the common sense approach he promotes through his climate policies, Stephen Harper is still only heading a minority government. All of the progress he brought about can easily be undone in just one election, unless enough voters wake up. Unfortunately, the majority of eligible voters no longer bothers going to the polls.
